Tangier January 6, 1897

The Marquis of Salisbury K.G. fy Lord,

Jewess came to the Consulate yesterday morning and charged a British indu Subject, a seller of Indian wares in Tangier, with having committed rape upon her on the previous evening. As both the Chief Justice and the Attorney-General of Gibraltar were here engaged in another trial, and as the case was too grave to be settled in the Consular Court and would have had to be remitted to Gibraltar, I thought it would be more convenient, from every point of view, and in the interests of the parties concerned, to have it tried at once here before the Chief Justice. Your Lordship was pleased to approve of the suggestion I made in this sense, and the trial took place and was concluded today. The accused was found guilty and sentenced to seven years’ penal servitude.

He is, for the present, lodged in the Consular gaol: but I would submit, in view of the local conditions, that it will not be possible for him to serve his term of imprisonment in the Consular prison. I would be glad to be instructed how I am to dispose of the prisoner. The most convenient and natural course, according to the order in Council, seemed to me to send the prisoner to undergo his sentence at Gibraltar: but it is possible that the Colonial Authorities may be disinclined to bear the expense of keeping a prisoner convicted of an offence committed outside of their jurisdiction. I trust that some arrangements may be made as to this point, as if I am not permitted to send the man to Gibraltar, I do not know of any other place outside the United Kingdom which would be more inclined to accept him.

יהודייה באה אתמול בבוקר לקונסוליה והאשימה הודי אזרח בריטניה, המוכר סחורות הודיות בטנג׳יר, באינוסה בערב הקודם. מכיוון שהשופט הראשי והתובע הכללי של גיברלטר היו כאן — במסגרת עיסוקם במשפט אחר — ומכיוון שהעניין רציני מכדי שיהיה אפשר ליישבו בבית המשפט הקונסולרי והיה צריך להעבירו לגיברלטר, חשבתי שיהיה נוח יותר ושהאינטרס של כל הצדדים הוא, שהנושא יידון כאן בפני השופט הראשי, ואדוני אישר צעד זה. המשפט נערך היום. החשוד נמצא אשם ונשפט לשבע שנות מאסר. בינתיים הוא נמצא בכלא הקונסולרי, אבל בהתחשב בתנאים, הוא לא יוכל להישאר במקום זה במשך כל תקופת מאסרו, ואשמח לקבל הוראה כיצד עלי לנהוג באסיר. הנוח והטבעי ביותר – להעבירו לגיברלטר. אבל ייתכן שהשלטונות הקולוניאליים יסרבו לשאת בהוצאות הקשורות בפשע שבוצע מחוץ לשטח שיפוטם. אני סבור שניתן לעשות סידורים מתאימים בקשר לנקודה זו, כי אם לא יורשה לשולחו לגיברלטר, לא ידוע לי על מקום אחר מחוץ לממלכה המאוחדת שיהיה מתאים יותר.

בהתכתבות בנושא זה מ־4 בינואר 1897 עד 18 ביולי 1899 נדון גורלו של האנס. מתברר שנעצר ב־4 בינואר; נשפט בבית־המשפט הקונסולרי ועורך־הדין שייצג אותו, ללא תשלום, היה הנרי פיזאני(Pisani). השופט כתב שהנאשם טוען לחפותו. הוא יליד 1865, נשוי ואב לשלושה ילדים. נדון לשבע שנות מאסר. ב־29 באפריל 1897 ערער על פסק־הדין, ושוחרר ממאסר ב־24 בפברואר 1902. ישב אפוא כחמש שנים.
