חיים ביינארט-אנוסים בדין האינקויזיציה-דרל פעולתו של בית הדין בסיאודד ריאל-1965

 

לעתים אין ללמוד מן המשפטים אם הללו באו להעיד מרצונם או שחוקרי האינקויזיציה, מששמעו על המגע ההדוק שבין הנאשם לאותם יהודים, קראו אותם לחקירה. ומותר לנו להקשות: מתי נקראו להעיד, אם קודם לפתיחת המשפט, בתקופה שבה נאספה אינפורמציה בחקירה מוקדמת על הנאשם, או כבר בשעת מהלכו של המשפט נקרא העד היהודי להעיד באודיֶנסיה סודית. אין להכריע בדבר, וייתכן שבדיקת כל המשפטים שהיו בהם עדים יהודים תזרע אור כלשהו על פרשה קשה זו לעצמה.

לענין סוגם של העדים יש עוד להוסיף ולשאול באיזו מידה נתקבל הוידוי על דעת האינקויזיציה כעדות נגד הנאשם עצמו. מהכרזות בית־הדין בבואו לסיאודד ריאל (או לכל מקום אחר) למדים אנו שוידויו של הנאשם שנעשה בתקופת־החסד והוכר על־ידי בית־הדין כוידוי מלא, פטר אותו מן הדין עצמו, אבל לא פטר אותו מכפרת עוונות ומהשתתפות באוטו-די־פי. ואילו וידוי שהוכר שלא נעשה בשלמות ובכנות, כלומר, אם אסף בית־הדין חומר מרשיע ממקור אחר, או שהמתודה לא מסר על אחרים שהיו שותפים עמו בקיום מצוות, נראה היה כעדות מרשיעה נגד הנאשם, והאינקויזיציה דנה אותו על־פיו. וידוי כזח היה מצורף בתיק, בתחילתו או בסופו, כהוכחה נגד הנתבע לדין. נמצא שנשקפה סכנה למתודים שהם יגרמו להרשעת עצמם. זוהי הסיבה שלעתים תכופות נמצא שלכל וידוי־הודעה נתלוותה הצהרת הנאשם, שאם יהיה לו מה להוסיף לדבריו, ואם ייזכר בעוד דברים שעבר עליהם, יוסיף מרצונו ויתודה ויודיע. הרי שהצהרה כזאת, על אף הנסיון מצד המתודה־הנאשם להשאיר לעצמו פתח של הגנה, שיסודו בשכחה או באי־זכירה, היה בה כדי להחשיד את המתודה שהוא מעלים משהו מן האינקויזיציה. אך נראה שחייבים אנו לתת דעתנו לצד נוסף של הבעיה. וידוי כזה היה קובע את גורלו של הנאשם, אלא שהאינקויזיציה היא שקבעה מהו וידוי־אמת ומה אינו כך. לכאורה אסור היה לה לשפוט את הנאשם על יסוד וידויו שלו והיה עליה לחפש עדויות מסייעות למעשיו של הנתבע לדין. והיא אמנם הביאה ברוב המקרים עדויות מרשיעות נגד הנאשם. הוידוי יכול איפוא להיראות בערכו כעדות מסייעת לצדקת טענתה, אלא שהיא ראתה בו את היסוד העיקרי והראשון במעלה, וכנראה נבעה תפיסה זו מעצם כוחו הקושר של הוידוי. אף־על־פי שהוידוי, מבחינת תפיסתו התיאולוגית, וכוחו של הכומר המודה (אותו ביקשה לפסול מתוך טענה שהוא לא הצליח בקבלת וידויי־אמת מן האנוסים הנתבעים לדין) חורגים מתחום הערכת עבירות שעליהן יש לערוך משפט־אינקויזיציה, הנה משהעמידה האינקויזיציה את מעשיו של האנוס בתחום הכפירה בכנסיה הקתולית היא נעשתה מכפרת עוונות ומטילה ענשים על וידויים לא מלאים או וידויים שכינתה אותם בשם וידויים מזויפים ומבוימים. והיא שנהפכה בעצמה למוסד המציל את נפשו של החוטא־המתודה, הנתבע על־ידיה לדין, מדראון־עולם על־ידי שציותה לשרוף את גופו.

כידוע, קיבלה האינקויזיציה כל עדות שנמסרה בין אם העד ידע על המעשה שעשה הנאשם על־פי ראיה שראה אותו בקיום המצוה ובין ששמע אותו בדברו דברים שונים. אבל ביסוד העדות על השמיעה לא ראתה צורך לקבוע סייגים. ענין השמיעה נתפרש על־ידיה גם אם העד שמע על הנאשם מפי אחרים. היא הסתפקה במה שהעד סיפר לה על הנאשם ולא חקרה ולא בדקה אותו על מקור ידיעותיו. לשיטה זו של צורת הידיעה היתה השפעה גם על שיטת העדות של הסגיגוריה, שגם היא ביקשה לדעת מן העדים ״אם הם ראו, שמעו, או שהם יודעים״.

עדות הראיה, השמיעה והידיעה, נתבססה על זכרונו של העד וכושר ראייתו ותפיסתו שלו בסיטואציות ובתנאים שיש בהם כדי לציין שפלוני או אלמוני קיימו מצוות. וכל־כך גדול צריך היה להיות רושם מעשהו של הנתבע לדין, או שהוא נעשה פעמים כל־כך רבות, עד שנחרת בזכרונו של העד למשך שנים ארוכות, או שרושם ביטויו או דבריו של הנאשם היה כה מכריע שלא נעלם, כלשונם, מן הזכרון. מצד אחר ביקשה התביעה להוכיח בעזרת עדיה שהנאשמים על־ידיה קיימו מצוות תקופה ממושכת, שאין קיומה של מצוד. יהודית זו או אחרת ענין חד־פעמי גרידא אלא מעשה ממושך, מעשה ביודעין ובמחשבה תחילה. את משך המעשים היא הוכיחה בעזרתם של עדים רבים, ועדות כולם היא הבונה את בנין האשמה בתיאורה השלם והמלא. אף־־על־פי־כן יש להתפלא על זכרונם המופלג של עדים שונים, שעדותם אינה מוכחשת והיא מתקבלת על הדעת כודאית וכסבירה בתנאי קיומם של האנוסים ודרכם בקיום מצוות החל במחצית המאה הט״ו, שעה שרבים מהם נתעוררו לשוב אל דת אבותיהם ואל צור־מחצבתם. יש להוסיף ולהדגיש את טיב הבנתם העמוקה של העדים במעשים יהודיים, ולעתים נמצא בהם הבחנה דקה מן הדקה.

התביעה ידעה להבחין בין אמת שנמסרה מפיהם של עדיה לבין עלילה. לגבי נאשמי סיאודד ריאל לא שעתה האינקויזיציה לפעמים לעדויות שמעין ריח עלילה נודף מהן. העדויות לעצמן הובאו בתיקו של הנאשם, אלא שההסתמכות על העלילה כמעשה שעשה הנאשם לא הובאה בכתב־התביעה ולא בפסק־הדין.

 הסיבה שלא נזקקה האינקויזיציה לעדויות מסוג זה נעוצה אולי בבטחונה בדרך הוכחת אשמתם של אנוסים בעוונות התיהדות, ולא היה לה כל צורך להזדקק לאמצעים אלה להוכחת צדקת דרכה. היא הוכיחה בעזרת עדיה את מעשי האנוס בכללם, שנעשו בחוגו הפנימי, בהסתר וזמן ממושך, ואלה היו היסוד לבנינה. לעומת בנין זה תיראה דרכה של הסניגוריה בהיאחזה בדברי עדיה כמעשה תלוש מאוד מן המציאות. עדי־הסניגוריה, שהכירו על־פי רוב את הנאשם שנים אחדות בלבד, מסרו רק מה שראו עיניהם או שמעו אזניהם בשלב חיצוני מסוים בדרך־חייו של האנוס, אפילו המדובר חוא בעליות־לרגל נוצריות, או בהזמנת ציורי איקונין ובבניית קאפלה בכנסיה. מעשים אלה נתפסו על־ידי האינקויזיציה כמעשים שנעשו למראית־עין בלבד, ואין משקלם עולה בשום פנים בקנה אחד עם משקל מעשיהם היהודיים והזמן הממושך שבו קיימו האנוסים מצוות תורת משה. זהו ערכן של עדויות־התביעה מבחינת אמיתותן הפנימית היהודית, כנגד ערך דבריהם של עדי־הסניגוריה על מעשים שעיקר כוונתם הוא כלפי חוץ בלבד. מכאן שאין הכרח שאמת אחת תסתור את חברתה. אנוס יכול היה לקיים מצוות וגם לתת בזמן מסוים משלו לכנסיה, והאינקויזיציה הבחינה היטב בתנאי מציאותם של האנוסים. אבל יש להדגיש כי חשיבותה ההיסטורית של אמיתות מעשיהם היהודיים של האנוסים גדולה היא לאין ערוך, שהרי נידונו הללו כאנשים השבים אל צור־מחצבתם, אל עמם ואל דתם. בתפיסה זו יש אמנם כדי להוסיף אישור לטענתה של האינקויזיציה על יהדותם של האנוסים; אך אין אנו באים לדון כאן בטענותיה, אלא בדרכה וביחסה אל אנשים אלה, שבכוח הוציאו אותם מדתם ומתוך עמם, ואפילו ננקטו אמצעים אלה מתוך הכרה מוחלטת ׳שיש להציל כביכול ולהושיע את נפשותיהם של המבקשים לשוב לעמם ולדתם.

ועל עוד ענין אחד בעדות חייבים אנו לתת דעתנו: זמנה של העדות עצמה ואישורה. כידוע, ניתנה העדות בתחילתה בתקופת־החסד לפני חוקרים מיוחדים, ולאחר־מכן אף משפקעה תקופת־ההסד. העדות נרשמה בספר־העדים, וממנו הועתקו לתיקו של הנאשם, אם הוחלט לתבעו לדין ואם הוכן תיק לנאשם. במהלך המשפט נקרא עד־התביעה להופיע לפני בית־הדין לשם אישור העדות מחדש. במעמד זה נשאל העד לאחר שהושבע כדין אם העיד, נגד מי העיד ומהו תוכן העדות. משהשיב על כך, הושלה תוכן עדותו למה שהעיד קודם־לכן ונרשמה עובדה זו. אז הוקראה לפניו עדותו הראשונה והוא שב ואישרה מחדש. חשיבותו של סעיף זה היא לשם הוכחה שלא נאמר לו בביודהדין מה עליו להעיד. אם לא זכר את עדותו, והוא ביקש שיזכירו לו אותה מחדש, נקראה זו לפניו. רק לאחר־מכן נשאל העד אם לא העיד מתוך שנאה לנאשם.

הד'ימים-בני חסות יהודים ונוצרים בצל האסלאם-בת יאור-כתר 1986- הרחקת הד׳ימי מן ההיסטוריה

 

הרחקת הד׳ימי מן ההיסטוריה

במישור הקיבוצי באה תסמונת הד׳ימי לידי גילוי במחיקת תולדותיו, תרבותו וקיומו המדיני של עם, מחיקה זו היא פועל־יוצא מאימוצו או גזילתו של העבר הד׳ימי על־ידי הקיבוץ המנצח, הרואה עצמו יורש חוקי לכל הציביליזציות שקמו בשטחים הכבושים. אכן הפקעת צלם־אנוש ומחיקתו יש קשר דיאלקטי ביניהן, שהרי קיבוץ תת־אנושי אין לו מקום בהיסטוריה של המין האנושי. שחיקתו של העבר הד׳ימי לא מקרה היא אלא יש בה משום ביטוי לעקירת ההיסטוריה של העמים הד׳ימיים. גילגולו של קיבוץ ממעמד אנוש לתת־אנוש מנחיל לקבוצה השלטת את המורשה התרבותית — ציביליזציה, אמנות ומדע — של הקבוצה הנשלטת, שבגלל מחיקת צלמה האנושי פקעו זכויותיה. הורדה זו של יורשיה החוקיים של תרבות למעמד של עבדים נרצעים, שמטעמי כדאיות כלכלית הם נסבלים על־ידי הקבוצה העליונה, מחסלת את העוררים היחידים העשויים לתבוע להם את הזכויות שנוטלים החמסנים לעצמם. מחיקת צלם־האדם של הד׳ימי מחייבת אפוא בהכרח את מחיקתו גם במישור ההיסטוריה והגיאוגרפיה. האימפריאליזם התרבותי מצדיק את האימפריאליזם הטריטוריאלי; התרבות, שקבוצת־הרוב תפסה לה מונופול עליה, רוקנה אותה ממשמעותה ועשאתה נכס פוליטי, הופכת להיות מכשיר נוסף של שררה וניכּור.

 הסיכסוך הערבי־הישראלי מדגיש את הטאקטיקה הזאת. התעמולה האש״פית המותאמת לכלי־התקשורת המערביים מכוונת, על־ידי סילוף סימאנטי, להחליף בהיסטוריה את היהודים בערבים־פלשתינאים. תהלוכת־המסכות של ערבים (או ״פלשתינאים״) המציגים עצמם כ״יהודים״ מעבירה לידיהם את הזכויות ההיסטוריות של ישראל ואת היתרונות או האהדה שנרכשו לאחר 4000 שנות קיום ותלאה. על־ידי שהוא חומס מן היהודים את עברם (ז.א. תחבולת ההחלפה), אש״ף מורידם לדרגה של קבוצה תלושה, נטולת־ממשות, שלכל היותר היא ראויה לסובלנות בלבד מצד הערבים.

במסיבת־עתונאים שקיים ב־2 בספטמבר 1983 באו״ם בז׳נבה, לאחר שנאם ב״ועידה לשאלת ארץ־ישראל״, הצהיר יאסר ערפאת:

אנו היינו תחת שלטון האימפריאליזם הרומאי. אנו שלחנו לרומא דייג פלשתינאי בשם פטרום הקדוש, והוא לא די שכבש את רומא אלא כבש גם את לבות העם.

אנו ידענו איך לעמוד כנגד האימפריאליזם והכיבוש. ישוע הנוצרי היה הפ׳ידאי הפלשתינאי הראשון שחגר את חרבו בדרך שבה הפלשתינאים נושאים כיום את הצלב שלהם (תרגום סימולטאני של האו״ם מערבית).

הנה כך, לצורך המאבק הערבי־הפלשתינאי מתגלגל ישוע הנוצרי בדמותו של פ׳ידאי — על (ז.א. לוחם־אסלאם) פלשתינאי, ויאסר ערפאת מקושר במישרים אל מייסדה של הנצרות.

יתר על כן: כל הקשור לתרבות נעשה מונופול של האומה. כל הצטיינות רוחנית מצד הד׳ימים סופה שנחשבה שחצנות. כדי שנוכל להעריך אל־נכון את הבזיון שבמעמד הד׳ימי חובה עלינו לשוב ולשבץ את המונח ״השפלה״ במערכת־הערכים של החברות הערביות, שהכבוד תופס בה מקום ראשון־במעלה. חוק השתיקה שנאכף על קבוצה מסוימת, הנחשבת נחותה מבחינה מוסרית, אף הוא היה גורם חשוב בהסתאבותם הפסיכולוגית של הד׳ימים. הסירוב לקבל את עדותו של הד׳ימי נגד מוסלמי בבית־דין דתי קובע עמדה וחושף מתכונת נפשית האפיינית לשתי הקבוצות. קבוצת הד׳ימים, ששוב לא היה בידה להתגונן, הועמדה במצב של בת־ערובה הצפויה לכל עלילת־שווא. היה זה מצב של חלישות מתמדת, שעודד התרפסות וחנופה. לאחר האמאנציפאציה ציינו קונסולים אירופיים עד כמה הד׳ימים מפחדים לעמוד על זכויותיהם ולפעמים אפילו לנצח בערכאות, שהרי ״התחצפות״ מצד הד׳ימי יכלה להביא עליו עונש־מוות. (ראה תעודות 35 ו־52).

בעיני הקבוצה השלטת היה סירוב זה לקבל את עדותו של הד׳ימי בבית־דין סמל לסירוב גדול יותר — סירוב להקשיב, ליצור מגע, להחליף דעות; קיצורו של דבר: סמל לכפירה בסבל הזולת ובזכויותיו. מניעת חופש־הדיבור דנה את העד לשתיקה. עינוי זה, פסילה זו של עדות, מועברים מן הפרט אל הכלל ומונצחים בזמן. שהרי היסטוריה מהי אם לא עדותו של עם בהמשך הדורות, עדות שעליה מבוססות זכויותיו. מחיקת ההיסטוריה שלו מבטלת את זכויותיו, וכך ניתן לו לפירוש הרשמי של המאורעות להיעשות אפום שבו יישמע רק קול אחד בלבד.

L'apprentissage des jeunes filles dans un « bled »

Le problème général de l'apprentissâge se pose d'une manière particulière dans ces endroits reculés et déshérités du Maroc qu'on est convenu d'appeler le « bled ». Il n'y est pas toujours question de développer l'artisanat. Des tâches plus urgentes s'y imposent. La population de ces coins éloignés, vivant en marge de l'œuvre civilisatrice qui se poursuit au Maroc, ignore le plus souvent les métiers les plus primitifs et presque les gestes élémentaires de la vie quotidienne.

Aussi les rapports de nos instituteurs qui acceptent le sacrifice d'une mission dans le bled nous transportent dans ce monde de la mythologie où des génies bienfaisants enseignent aux hommes les premiers arts ou ravissent pour eux le jeu du ciel.

Voici le rapport d'une institutrice de Demnat, petite localité aux environs de Marrakech :

À Demnat, les parents n'attachent aucune importance à l'instruction des filles. Une fille n' est bonne que pour être reléguée à la maison. Elle y aide sa mère dans les travaux du ménage. Mais le plus souvent, elle est honteusement exploitée  par les siens qui la mettent en apprentissage chez une couturière dès l'âge de 6 ou 9 ans. Quand elle sait bien coudre a la machine, vers 11 ans, elle s'établit, elle aussi, couturière. Ce sont- alors des journées épuisantes pour la malheureuse fillette. Levée avec le soleil, elle se met courageusement au travail. Vous la trouverez encore le soir, à  la lueur vacillante d'une bougie, penchée sur son ouvrage. A 12 ou 13 ans, c'est le mariage. Le mari continuera à exploiter sa jeune épouse autant, sinon plus, que les parents de cette dernière. C'est la belle-mère qui s'occupera du ménage. Les filles sont donc une source de revenus et les parents hésitent de ce fait à les envoyer à l'école. Que pourraient-elles y apprendre d'utile ? A ce besoin de connaissances ayant une utilité immédiate, j'ai essayé de répondre. J'ai été incitée à initier mes élèves aux travaux de futures mères de famille : ménage, puériculture, hygiène.

 Couture

Toutes les fillettes, même les plus jeunes, savent manier habilement l'aiguille. A l'heure de la couture, je leur apprends à couper leur linge plutôt que les différents points d'ornement qu'elles n'utiliseront pas. J'ai commencé par les mouchoirs. Tous nos élèves se mouchaient dans d'affreux chiffon malpropres. Chacun d'eux a apporté un mètre de calicot avec lequel les écolières ont confectionné six mouchoirs. Puis ce fut le tour des culottes. Ce fut une innovation , jusqu'alors, les culottes passaient à Demnat pour une pièce d'habillement exclusivement masculine. Maintenant, mouchoirs, culottes, chemises et combinaisons fabriqués par nos jeunes filles y ont fait leur apparition.

Habillement

Les femmes s'habillaient de trois ou quatre jupes superposées d'une casaque et d'un foulard chatoyant laissant voir de longues nattes tressées, arrivant jusqu'aux hanches. Elles allaient pieds nus dans la rue comme à la maison. Les écolières aux gentilles robes, clairs tabliers, cheveux courts et espadrilles blanches, furent un étonnement Les mamans de nos élèves, les premières, voulurent porter, elles aussi, des robes. Quelques-unes m'ont priée avant Paque de leur en couper ; les couturières d'ici étant incapables de le faire. Ces dernières se sont emparées des modèles que j'ai taillés. La mode des robes était lancée. A la Pentecôte, j'ai remarqué avec plaisir que beaucoup de jeunes femmes portaient de fraîches toilettes de leur âge et non plus ces jupes amples de grand'mères où leur corps harmonieux perdait toute grâce.

 Tricot

Au début de l'hiver, j'ai enseigné le tricot. Mais que de  difficultés ne m'a-t-il pas fallu surmonter  On ne trouve pas à Demnat d'aiguilles et de laine à tricoter. J 'allais renoncer à cet enseignement indispensable quand j'eus l'idée d'utiliser comme aiguilles, les rayons de bicyclette qu'on vend à un sou la paire et la laine filée ici par les femmes. Le lendemain, toutes les fillettes avaient le matériel nécessaire. Le fil est grossier et irrégulier, les aiguilles bien fines. C'est un pis aller qui a permis pourtant, en utilisant les ressources locales, d'habiller chaudement toutes nos élèves et beaucoup de leurs petits frères ou soeurs. Pull-over et cachecol qui ont avantageusement remplacé les serviettes de toilette qu'on metoaiit autour du cou, ont été tricotés en classe.

Cuisine

Certains dimanches, je fais venir chez moi les grandes filles âgées de 10 à 12 ans pour leur apprendre à faire des biscuits, des gâteaux et certains plats. Assises amtour de la table de la salle à manger, ayant devant elles la farine, le sucre qu'elles ont apporté, ces élèves suivent attentivement mes mouvements et mes explications. Dans les recettes copiées en classe et qu'elles ont sous les yeux, j'indique le nombre de verres d'eau ou de farine, de cuillerées à café ou à soupe de sucre ou d'huile nécessaires, plutôt que les poids ou les capacités de ces denrées. Chaque élève pétrit seule sa pâte, me la montre et si celle-ci est à point, elle l'étend au rouleau, puis la découpe avec un couvercle de boîte en fer blanc. Plusieurs fillettes préparent chez elles les biscuits qu'elles ont appris à faire.

Il y a peu de légumes à Demnat. La population se nourrit tous les jours, et cela pendant des saisons entières, soit de carottes ou de navets, soit de courges, de pommes de terre ou d'aubergines. On ne trouve rien d'autre en dehors de ces légumes. On comprend la répugnance de ces pauvres gens à manger tous les jours le meme plat préparé de la même façon. J'ai enseigné aux fillettes pendant ces dimanches à cuisiner ces légumes de trois ou quatre façons différentes. Les mamans ont tiré profit du savoir de leurs filles et ont appris ces recettes qui leur ont permis (l 'introduire un peu de variété dans la préparation d'un même légume.

 Au cours de ces séances, les élèves sont , très à l'aise. Nous causons familièrement de tout. Mais je ramène souvent la conversation sur leurs parents leur façon de vivre, leurs moeurs. J'apprends ainsi une foule de choses que les fillette ne m'auraient pas confiées en classe. Je les interroge sur leurs petits frères ou sœurs et leur donne des conseils sur la façon de les habiller, de les nourrir, de les elever. Souvent quand je dois habiller nia petite fille ou la  baigner, je le fais devant elles. Je leur recommande de raconter a leurs parents ce qu'elles voient chez moi, d'essayer de les persuader qu'il faut baigner les bebés, les tenir propres pour qu'ils soient bien portants.

 Cet enseignement intéresse beaucoup les élèves. Malheureusement elles quittent bien jeunes l'école, à 11 ou 12 ans, pour se marier. Nous luttons,, mon. mari et moi, pour abolir cette coutume, d'une autre époque.

 Malgré-le-jeune âge où ces fillettes nous quittent je suis convaincue que cet enseignement portera ses fruits et transformera leurs futurs foyers en y introduisant un peu plus d'hygiène et.de bien-être. Elles acquerront plus de dignité aux yeux de leurs maris qui cesseront de voir en elles leurs inférieures. Ils leurs accorderont la considération et le respect que l'époux doit à son épouse clans les sociétés civilisées.

Notons que des initiatives dans le genre de celles que relate notre institutrice de Demnat sont prises un peu partout et sont accueillies par la population avec le même élan de reconnaissance.

Notre directrice nous écrit  « Depuis, un an, fonctionne à-Mossoul un atelier.de couture. Je suis satisfaite de la marche; que suit cette œuvre. Bien qu'encore, petite, elle est en  train de former un noyau de jeunes filles  qui pourront avoir un gagne-pain-plus tard. Les inquiétudes" des jeunes

" Notre directeur de Demnat se préoccupe de l'avenir de ses élèves. Et déjà le groupe horticole qui fonctionne à Marrakech  depuis le mois  de mars et dont , nous avons parlé (dans le dernier numéro –de Paix- et Droit,, apparaît.comme un espoir. « Mes grands.élèves, nous écrit-il, se demandent anxieusement ce qu'ils feront quand ils quitteront l'école. Le commerce ne leur dit rien qui vaille. Il y a trop de marchands de tissus, de sucre et de thé. Quant aux métiers manuels, ils n'ont plus de débouchés: Forgerons, menuisiers, bailleurs, bouchers,-sont nombreux : et gagnent péniblement leur. vie. Ceitte situation ira  en s'agravant. Et les, enfants voient venir avec angoisse le moment où, eux aussi, auront à gagner leur vie. Ils m'ont fait part de leurs vivres préoccupations et j'ai pensé-les orienter ver le travail de la terre. Pour eux qui-vivent à la-campagne, il leur sera facile de s'adapter a ce dur. labeur. Ils montrent d'ailleurs beaucoup de zèle quand nous faisons du jardinage. Ce sera un moyen de les attacher a leur bled et de les empêcher d'aller grossir les rangs de tous ceux qui vivent sur les budgets des communaiiibés des grandes villes. L'école agricole rattachée  a l'école Jacques-Bigart, de Marrakech, réservera quelques places pour les grands élèves de Demnat. Leurs études finies, ils pourront trouver à s’employer comme ouvriers agricoles chez les colons de la région. »

Cette solution n'est pas toujours possible, car l'envoi des jeunes dans une ville voisine pose la question de leur hébergement. Mais parfois ce projet est réalisable. Notre directeur de Sefrou, par exemple a placé dans le nouvel atelier d'apprentissage ouvert près des écoles de Fès, six élèves  en même temps qu'il a envoyé quatre enfants au cours complémentaire de cette ville.

 Pour l'année 1936-1937, le nombre des apprentis envoyés à Fès est porté à 10. Mais aucune ressource locale ne , doit être négligée. En effet, a Sefrou même, notre directeur a fait des démarches pour introduire dans les programmes pour les fillettes une demi-journée de couture et d'enseignement ménager, et pour les garçons l'apprentissage horticole. Il a obtenu, pour 1936-1937, l'engagement de l'un de ses grands élèves dans le « jardin d'essai » de Sefrou. Il y voit un heureux présage et, peut-être, une perspective d'avenir.

קמעות להגנה על האם ועל התינוק: נועדו לשמירה ולהגנה מפני עין רעה, שדים ומזיקים. הקמעות נתלים בפתח חדר היולדת או מעל למיטתה: הם עשויים כקמעות כתובים או מודפסים, על קלף או נייר, ותוכנם נלקח מתוך מזמור קכ״א מתהילים, בצירוף שמות מלאכים, אדם וחוה או שמות האבות והאמהות. לאלה נוספות השבעות שונות:

לשמירת היולדת והילוד מפני כישוף: קח קלף מעור צבי וכתוב עליו: ״בשם קוף קפו וקף ופק פקו קום״ וקשור לה על טבורה ולחוש לה באזנה הימנית

לשמירה לאחר המילה: גוזרים לארבע יריעות את מפת הפשתן, עליה נימול התינוק, ומחברים לחיתול ארוך. עליו רוקמים או מציירים את הילד ותאריך לידתו בצירוף האיחול: ״ה׳ יגדלו לתורה, לחופה ולמעשים טובים, אמן סל״ה״.

סגולה לחלום טוב: ״ש״ח יא על מטתו בנקיון כפיו: אלוהי, אלוהי האמת, הראני חלום טוב, אלוהי אלוהי האמת הראני חלום טוב, אלוהי אלה הצדק, הראני חלום טוב. הראני חלום שאדע בו מה שאשאל, כי אל דעות ה׳. ולא ידבר עד שישן וכשיעור, מה שיבוא בפיו היא תשובת שאלתו״.

Crisis and Community: the People of Tangier and the French Bombardment of 1844 Susan Gilson Miller

History is full of cataclysmic events that mark the end of one era and the beginning of another. Every society has its own particular calendar of catastrophes, engraved in memory and marked by ritual. So it is with Morocco, where the date 1844 looms large. That summer, a French naval and land force attacked the domains of Sultan Mulay Abd ar-Rahman and brought an abrupt end to Morocco's self-imposed isolation from European affairs. The coastal towns of Tangier and Mogador were bombarded, and the Moroccan army was defeated at the River Isly. The events of 1844 were the explosion that propelled Morocco into a new era. Indeed, the major theme in Moroccan history for the next half-century was its growing entanglement in the web of European rivalries, culminating in its partition by France and Spain in 1912.

 From Europe's standpoint, the Moroccan crisis of 1844 was merely one swift and nearly bloodless clash in a century laden with conflict. But from the Moroccan perspective, it was a disastrous moment of deep national trauma. Local sources make clear the extent of the debacle from the Moroccan point of view, and sharply illuminate the perturbed emotions of those who were on the receiving end of the French attack. The ramifications of the event soon reached to every level of Moroccan society, influencing court policy and coloring the popular imagination. Our specific interest is in how the bombardment of 1844 affected relations between Muslims and Jews in Tangier, where the latter group formed a large and significant minority. The bombardment exacerbated already existing tensions between the two groups and foreshadowed deeper troubles that lay ahead. For one brief moment, the event bound the two together in common awe of the threat from the West. But it was a unanimity that would not last. It can be reasonably argued that the unravelling of the bilateral relationship that occurred later in the nineteenth century had its roots in the divergence in perspectives and purposes between Muslims and Jews exposed by the crisis of 1844.

 The interest of the French in Morocco was ignited by the conquest of neighboring Algeria in 1830. Fourteen years later victory remained elusive because of the tenacious resistence of the Amir Abd al-Qadir, who used eastern Morocco as a base for cross-border raids. The French then vented their frustration on Morocco. In mid-July, a heavily armed fleet under the Prince de Joinville, Louis Philippe's third son, appeared in the Moroccan port of Tangier. The resident French consul, his staff, and their families were taken away, soon to be followed by the consuls and nationals of other Christian nations. The departure of the Europeans caused a panic among the local population. Some tried to escape by sea, while others fled to the countryside. Even the troops garrisoned in the town ran away. One Moroccan noted with chagrin that 'the place emptied out completely, even before a shot was fired, even before one Frenchman landed'.

 Days passed as the young and indecisive Prince awaited instructions; finally, in the early morning hours of 6 August he opened fire. Three hundred and eighty pieces of artillery aboard fifteen vessels suddenly released a storm of shot 'so tremendous, so uninterrupted, so destructive' that after three hours, the 'walls of the town looked like lace'. When the smoke cleared, the Prince pronounced the attack a success, claiming he had fulfilled his orders to 'destroy the exterior fortifications, but spare the town'. The consul's quarter had been 'respected',. . . only 'five or six balls have fallen there'; moreover, French casualties were light – only nine dead and sixteen wounded. 'The victory is dignified … it has brought honor to the [Prince], the navy, and the French character,' declared Dr Warnier, chronicler of the campaign.

 For those on shore, it was a day of destruction and humiliation. The Sultan's son was put in charge of repairs, and he wrote to his father in a tone of disbelief: On the roof of the Great Mosque alone, I counted thirty-six balls … outside the city there are even more … [we] collected those that landed on the town and they number three thousand … people say that altogether, more than six thousand fell. For the people of Tangier, the terrible anger of falling iron became emblematic of the event; a cannon atop the Borj Bou Amair was said to have sunk a French ship, and later generations came to venerate it for its magical powers.

The mountain of cannonballs left behind were also a shocking reminder to Moroccans of the dramatic change taking place in their relations with the West. A modernizing Europe could now muster levels of force they could no longer match. The roar of the cannons carried a deeper message. The disparity between Morocco and France was not so much one of a lack of technical ability, but rather a deficiency in organization and discipline. The French gunners fired as one, their guns never ceasing. Shortly thereafter, the Sultan sent his first mission to France in many years, for the purpose of observing the French at close hand and fathoming the source of their power. In 1844, the door to the West swung wide, and the people of Morocco suddenly felt unsettled in their own house.

 THE JEWS OF TANGIER

The French decision to begin the campaign with an attack on Tangier was taken of set purpose. The town, called the 'gateway to North Africa' by Moroccans, was a sensitive node of contact between Morocco and the outside world. Europeans were rarely allowed to travel into the interior, making Tangier the first and often sole glimpse Westerners had of Morocco. Here the foreign consuls resided, along with most of Morocco's tiny European community. Here too lived a sizable Jewish population, the majority originally from the towns of Meknes and Tetuan, drawn to Tangier because of its bustling commerce. In the year 1840, the number of Tangier's Jews about 2,500, out of a total of 10,000. Most Tangier Jews traced their descent back to those exiled from Spain in 1492. Carefully guarding their 'Sephardic' heritage, they even spoke their own language, a Spanish dialect laced with Hebrew and Arabic called haketia. They were (and still are) a self-conscious group, fiercely proud of their ancestry, following their own variations on Jewish rituals, customs, and etiquette. Moreover, their closeness to Europe encouraged families to start branches at various points around the Mediterranean. Travel abroad and the mastery of foreign languages were part of the apprenticeship of young Tangier Jewish men of a certain social class. Spatial arrangements in the town also encouraged a sense of openness. Unlike other large Moroccan towns, Tangier had no mellah, or Jewish quarter, making relations with Muslim neighbors both freer and more frequent. These qualities set the Jews of Tangier apart from Jewish communities elsewhere and gave them a distinct identity all their own.

 European visitors arriving in Tangier in the early 1840s were struck by Jewish ubiquitousness. Travellers told how 'brawny' Jewish porters carried visitors ashore; Jewish consular employees greeted them on the beach and guided them on their visits to the town; they took them to their synagogues, and into their homes where they met their wives and daughters; Jewish merchants sold them trinkets; Jewish tailors cut their clothes; Jewish beggars dogged them in the streets. It seemed, according to one visitor, that the Jew 'does everything, and the whole commerce of the country is carried on through his means.

 Most visible were the Jewish merchants, who formed a tiny yet powerful elite made up of a few families linked by marriage and business interests. This group – perhaps ten per cent of the Jewish community – was emerging as the pre-eminent contact between local society and the European presence. In Tangier in particular, a handful of Jews combined the dual roles of businessman and diplomat, serving European consuls in countless useful ways while conducting their own profitable trade. Europeans in Morocco of the 1840s found themselves in a confined and alien environment. Usually ignorant of Arabic, hemmed in by travel restrictions and poor roads, they counted on the Jewish consular employee to ease the 'miseries' of life in the Orient. The Jew knew how to procure luxuries, could serve as a buffer with the 'barbarous natives', and, unlike the European, was permitted to travel into the interior. Each foreign consulate had its simsars, dragomans, agents – capable Jews in European employ adept at using positions of privilege to further their own interests.

To succeed at this work required sensitivity and tact, and a large dose of humility. A few Tangier Jewish families had already emerged in the 1840s as experts in this domain. Their names – Benchimol, Azancot, Abensur, Pariente – appear and reappear in the European sources, attesting to their indispensibility. Although their numbers were small, their prominence was due to their monopoly of control over the delicate synapses in the Moroccan-European relationship.

One such business-diplomat was David Azancot, 'auxiliary dragom of the French consulate, wealthy nephew of Abraham Benchimol, the principal 'native' employee of France in Morocco. David Azancot served the French as translator, go-between, jack-of-all trades, and valued commercial contact. He was the owner of property and storehouses, supplier to the French fleet, and the purveyor of all types of goods. When the artist Delacroix came to Tangier in 1832, it was David Azancot who accompanied him on his sketching expeditions; David's female relatives posed for Delacroix's provocative portraits of 'Moorish' women; his uncle Abraham's house was the setting for Noce juive, the sensual depiction of a Jewish wedding. When the writer Alexandre Dumas arrived in 1846, David was his guide. David Azancot was representative of a new and emerging variety of Tangier Jew, playing at the margins of Moroccan society, entering and leaving at will, comfortable with Christians and Muslims alike – a man, in Dumas's words, of 'good manners, prudence, and fairness', useful but not bold, trustworthy yet not intrusive.

2 – נטילת ידיים בבוקר: מקפידים על נטילת ידיים בבוקר, ומניחים קערה ונטלה של מים לפני המיטה כדי להימנע מהליכה של ארבע אמות לפני נטילה.

  • – נטילת ידיים בשחרית נעשית לסירוגין: יד ימין פעם אחת ואחר כך יד שמאל פעם אחת, שלוש פעמים.

הערות המחבר: באשר לזמן התפילה – לא הייתה מודעות לתפילת הנץ דווקא, אלא השכימו בהקדם סמוך להנץ (מפי כמה מסרנים, ובכללם ר׳ בנימין ב״ר אברהם לעסרי מקצר א־סוק).

לגבי נטילת ידיים בבוקר כתוב בשו״ע, סימן ד, סעיף ב: ׳ידקדק לערות עליהם מים שלש פעמים', בלי לפרט אם לסירוגין או ברצף או בפעם אחת על שתי הידיים, וברוב המקורות ההלכתיים מפורש לסירוגין(ראה משנה ברורה שם, ס״ק י). כן הוא בשער הכוונות, חלק א עט׳ ו, צד ב, המסמיך את דבריו על הזוהר (כ״י) וכותב שאין הטומאה מסתלקת אלא בנטילה לסירוגין. זהו גם מנהג שאר קהילות מרוקו(דברי שלום ואמת ג, עט׳ 83), אולם מנהג מראכש לעשות נטילה כפולה: תחילה שלוש פעמים רצופות על יד ימין ושלוש פעמים רצופות על יד שמאל, ואח״כ נוטלים לסירוגין (מ' עטיה, משולחן אבותינו, ישראל תשע״ה, שער א, עט׳ 13 סעיף יז).

כך מוסר גם אהרן ב״ר שמעון סבאג מגיגלאן. הטעם להקל בשבת הוא שמתחילים את התפילה באיחור ומסיימים באיחור. בשאר קהילות מרוקו נהגו להקל גם בחול, והמדקדקים החמירו (נתיבות המערב, עט׳ ה סעיף כד; עטרת אבות, פרק ג, סעיף ב).

Despite their apparent freedom, the Jews of Tangier were nonetheless subject to the prohibitive codes of behavior imposed on them by Muslim law and practice. Jews in traditional Islamic society, along with Christians, were ahl al-dhimma, a 'protected' group enjoying freedom of religious practice while acknowledging the superiority of Islam. This ambivalent situation of acceptance-cum-rejection permeates the Moroccan Jewish experience; indeed, it permeates the millenial experience of Jews in the Islamic world. Testimonies of good interpersonal relations between Jew and Muslim are offset by tales of shocking and gratuitous humiliation. Relations were both good and bad, fruitful and exploitative, friendly and hostile, defying categorization or generalization. The closeness of the two groups in custom, attitude, language and world view belied a vast gulf in matters of religion and social status. Jew and Muslim in Tangier lived in two separate worlds that intersected in the market place and in business associations, and occasionally, in the home. But frequent and easy movement from one world to the other did not remove the fundamental and deep cleavage between them.

Nevertheless, both Jews and Muslims felt themselves to be bound together in the same wider society, tied by mutual relations of economic, political, and social necessity. Throughout Morocco, but in Tangier and the other port cities in particular, Jews filled a vital economic role essential to the proper functioning of trade and commerce. Protection of Jews by the Sultan was a practical obligation as well as a moral responsibility, and it was the Sultan (then and now) who set the tone. In 1844, Tangier Jews, particularly those engaged in relations with Europe, were a key element in the body politic.

 The turmoil unleashed by the bombardment was felt acutely at all levels of Tangier society. For in the course of events, a major breach opened up between the Jews and the Sultan, and within the Jewish community itself – a breach that threatened to upset the delicate balance that years of a finely calibrated coexistence had created. Local versions of the bombard- ment reveal how the event was a watershed in the changing dynamic of relations between the two groups.

Recreating the bombardment from the Moroccan perspective would be difficult, even impossible, if we were confined to the European sources. A minor incident in European history, the event was a major cataclysm on the local level. The trauma it caused was such that it was written about, sung about, and woven into local mythology and lore. Like most Moroccan cities, Tangier has its own body of written and oral tradition that makes up the distinctive cultural apparatus of the community, reinforcing a strong sense of local identity. To be 'Tanjawi', or a person of Tangier, is a mark of pride. This feeling of distinctiveness is bound up with a particular historical consciousness, and is as much a quality of Jewish Tangier as it is of Muslim. Moreover, both groups traditionally shared certain attitudes toward local history, including an obsession with events as signs and symbols, a selective interest in historical 'facts', and an acute awareness of the immanence of God in the affairs of humankind.

Local sources for the bombardment of 1844 demonstrate many of these traits. Indeed, the principal Jewish source – a Purim scroll – is not history in the conventional sense at all, but rather a ritual document retelling events according to a liturgical formula. The Purim scroll tells how the French appeared in the port of Tangier on the 7th day of the Jewish month of Ab, just as the Jews were preparing to mark the tragedy of Tisha B'ab (the 9th of Ab), the day of the destruction of the Holy Temple and the onset of dispersion. Tangier's Jews marked the date each year with deep mourning, dressing in black and walking barefoot in the streets. It was the season of catastrophe, and the appearance of the ships increased the sense of impending doom. As word spread that the consuls were leaving, the Jews flocked to the port in panic: 'Israelite families implored us to let them depart with our nationals,' the French consul reported, but few were allowed on board. The arrival of a British ship set off the wildest frenzy: 'An English ship came into the port and all the Jews with an English passport went down to the port. Other Jews joined them, nearly half the Jews in the town, even those without papers . . . and everyone was shrieking and the port was like the Day of Judgment. Many Jews were allowed to board the British ships, even those 'without papers', and some two hundred or more Tangier Jews were taken away to Gibraltar. About 150 more Jews fled aboard Spanish vessels, leaving with the Spanish consul and his family for the Spanish port of Algeciras. In all, between four and five hundred Jews left Tangier aboard English, French and Spanish ships, about one-fifth of the Jewish population of the town.

The Jews who stayed behind in Tangier were terrified. The Purim scroll describes how they sat quaking in their houses 'weeping like a flock of sheep being led to slaughter'. Suddenly, the bombs began to fall 'like stones from the furnaces of iron'. Through the hours of the bombardment, they huddled 'like beasts', running from courtyard to courtyard. Some fled with their Muslim neighbors to the countryside, but this was no escape, for outside the safety of the town, they were at the mercy of unruly mountain tribes. Whether they remained or fled, each course of action had its dangers.

 Meanwhile, the Sultan, keeping abreast of events via his local correspondents, became furious when he heard of the flight of the Jews. He wrote in great anger to the Governor of Tangier:

 

The reason for the fright in Tangier was the people of the dhimma, God         make them repulsive, who incited and increased the commotion of the         Muslims. A group of them went to Gibraltar, about 150 of them who           are not employees (muta'aliq) of the Christians, and that is why Tangier       is completely empty of them . . . Tell the inspector of the port only to           allow those who are employed by the Christians and no others to leave,       and that is my order … as for the others who are not employees, when           they return they should be settled elsewhere, some in Fes, the rest in             Meknes, in order to cleanse the port and get some rest from them … for      whatever commotion took place only suits the purpose of the Jews, may   God curse their sect     

 

  Many Muslim inhabitants of Tangier also fled the town, but it was the flight of the Jews that became the focus of the Sultan's wrath. Their departure on European vessels and their escape into the arms of the enemy was seen as a flagrant and impious act of disloyalty worthy of severe punishment. But despite the dire threats, the Sultan's anger quickly abated, and soon he was actively promoting their return by offering guarantees of their safety. His motives are not difficult to discern; he was anxious to restore commercial activity to the port, for which the presence of the rich Jewish merchants was essential. By early October, affairs apparently were restored to normal: 'The fears of the people have been calmed, the Jewish merchants who fled have come back to renew their commerce, and goods are flowing as usual,' it was reported.

The immediate crisis was over, but its memory was deeply implanted in the collective consciousness of the community. Some years later, a British visitor to Tangier noted that the excesses committed … on the occasion of the French bombardment … are still vividly impressed on the memory of the living generation. Hence the Jewish inhabitants live in constant terror of the bare possibility of foreign war.

 The trauma of the event was such that it soon became enshrined in literature, ritual and the popular imagination. Not long after the bom- bardment, someone in the Jewish community composed a special 'Purim' to commemorate the event and to celebrate their 'miraculous' delivery. This scroll offers insight into the Jewish experience at the deeper psychic level, suggesting how the crisis elicited a complex communal response having far-reaching social implications.

 The Purim scroll is part of the communal liturgy of Tangier and is read in the synagogues on the anniversary of the bombardment. It belongs to the genre of 'special Purims', modelled after the original Purim story in the Bible, which tells how the Jewish community of Persia was saved from destruction by Esther, Jewish wife of the Persian King. Certain archetypal elements of the first Purim are often repeated in special Purim such as:

the threat to the community, the villain who plots against the Jews, the leaders who protect the flock, and finally, the deliverance, where God, the real master of events, intercedes and saves the Jews.

The first Purim is celebrated each year with merrymaking. But beneath the ribaldry and fun is a message of extreme seriousness; namely, that the redemption of the community comes only through the will of God. Special Purims are reminders of the same message and take place throughout the year. The Encyclopedia Judaica lists more than a hundred of them celebrated from Ancona (Italy) to Zborow (Poland), with the majority associated with the Sephardic ritual. The stories of rescue are varied, but they contain many of the elements of the original Purim, which served as their paradigm.

 The 'Purim of the Bombs' recasts the events of 1844 as a miracle of deliverance and tells how, through the intervention of God, the Jewish community of Tangier is saved from annihilation. It recounts that the dispute between the 'King of the French' and the Sultan (the Great One, Our Lord and Master) threw them into disarray. 'Our terror mounted, our senses were unhinged . ..' When the bombardment begins, the language becomes apocalyptic: 'we thought we would perish … everyone saw . . . the flashing of lights and the fire that fell on our country.' But then God intervenes: 'He got up from the seat of judgment and sat down on the seat of kindness . . . and the stones falling like meteors stopped . . . and not one person was lost from among us.' The scroll ends by reminding each generation to celebrate the event with rejoicing and happiness- even though it falls in the month of Ab, a time of lamentation.

 Another special Purim associated with Tangier is the 'Purim Edom', or the 'Purim of Europe', which commemorates the defeat of an invading Portuguese army at the Battle of the Three Kings near Qasr al-Kabir in 1578. An analysis of the text of this Purim indicates it is true to form, containing many elements of the original Purim story; the villain (the Portuguese King Don Sebastian); the threat (forced conversion of the Jews to Christianity); the Jewish communal leaders who try to save their flock (the community head of Fes, Abraham Rute, and his Marrakesh counterpart, Rabbi Joseph al-Mosni); the fear and trembling; and the final rescue.37 Comparing the two Tangier Purims shows that the 1844 scroll is both exceptional and problematic. The following elements, striking in their anomaly, offer clues to its underlying meaning:

(1)There is no villain in the piece. The French are mentioned merely in passing, without any of the phrases of vilification usually reserved for the enemy of the Jews. We know that some Jews fled the bombardment aboard French vessels, including David Azancot and his family.38 It seems that the Jews of Tangier were divided in their attitudes toward the French, some regarding them as rescuers and others as oppressors; therefore, the vague definition of the French role in the drama purposefully spares certain key members of the community of the embarrassment of having identified with the enemy.

(2)There is no mention of Jewish community leaders who strive mightily to rescue their flock. Perhaps the rabbis and other leaders who normally guide and counsel in moments of communal anguish were here divided in their response, creating yet another sore point best left unmentioned.

 (3) The use of language in the scroll is revealing. The exhalted words used to denote the Sultan (Adonaynu hu malkaynu – Our Lord, our King) are usually reserved for the Almighty. The Purim calls Morocco 'our country' (artzenu), in another fervent statement of patriotism. These respectful references to King and country had to be intentional. Such allusions are absent from the 1578 Purim, although not from other special Purims. Declarations of loyalty to the temporal power were often required of the Jewish people in exile. It may be that one of the underlying purposes of these rituals is overtly to articulate sentiments of loyalty and obedience to the temporal authority that Jewish behavior – from the non-Jewish perspective – may seem to contradict.

(4) Missing is any mention of events beyond the immediate vicinity, such as the devastating attack on Mogador. It is as if the bombardment had taken place in a vacuum, disconnected from its larger historical milieu. This feature may reflect the 'localism' of Moroccan Jewish historiography. But it also may express a need to eliminate all vestiges of the historicity of the event, transforming it to a different level of meaning. By purifying the event of its historical specificity, it quickly takes on the quality of ritual, fixing it in the collective memory as yet another example of the suffering and the redemption that, in the Jewish view, bind together the human and the Divine. Thus the Purim has the effect of reminding the Jews of Tangier of the omnipresence of God in the affairs of this world, and of their primal role in revealing His purposes to the rest of humankind.

The Purim also conveys messages about what it meant to be a Jew in Muslim society, by reminding the Jews of Tangier how to mold their behavior to the contours of long-standing paradigms of minority-majority relations. The first message in the Purim is about Jewish community. The non- Jewish sources revealed that the Jews of Tangier did not respond to crisis as a unit, but rather split into factions, the 'leavers' and the 'stayers'. The former group was made up of mobile, wealthy Jews being drawn into a new set of relations with a European-centered world. When crisis came, they activated those relations and fled. The latter group was composed of the majority of Tangier Jews, still bound in submission to the Muslim authority. When crisis came, they had no choice but to put their faith in God and hope for mercy from their Muslim protectors. The Purim text makes no allusion to a breach we know existed. Why? Because one of the scroll's express purposes was to eradicate the split from memory. Silence about the departed Jews implies that the danger threatened all, thereby reintegrating those who opted out of the collective experience. Rich and poor, Europeanized and traditional, 'leavers' and 'stayers', are reunited into the larger category of kullanu, 'all of us', who are equal before the will of the Almighty.

The importance of community in weathering crisis is one of the principal values that the scroll projects. It is only through collective action and collective identity that the Jew can withstand the pressures for assimilation exercised by the gentile majority. The scroll affirms that the ideal context for Jewish life in exile is the community, where the duties and pleasures of life are knitted naturally into the fabric of daily existence.

 The second message in the scroll is about relations with the wider Muslim society. The annual repetition of the Purim scroll is a tool for instructing the next generation, through ritual, how to survive as a minority. The Jews had misbehaved in the eyes of the Sultan; through the Purim text, they expiate their sin and restore their relationship with authority. The Sultan is the all- powerful master; the Jews are the weak and indecisive flock, confused and disarmed by events. This is the traditional relationship between Jews and the Muslim authority, between the submissive minority and the dominant majority. In 1844, most of Tangier's Jews were not yet ready to question that relationship. Through the Purim text, they are reaffirming their loyalty to the state and their acquiescence to a particular variety of social adaptation.

A third message is the assertion of the bilateral nature of the dhimma contract. When we speak of the notion of dhimma, often we neglect to mention the Jewish view of the pact. Did Jews feel powerless in their subordinate status, or did they feel capable of manipulating it? The Purim shows that Jews were able to act on their own behalf, mainly by reassuring their Muslim masters that the ties that bound them were firmly in place. Far from being a cynical act aimed at removing the Sultan's anger, the Purim is a subtle supplication for forgiveness, a positive and conscious effort to be restored to their special niche in society. The relationship of subordination, for all its negatives, was still a certainty in an unsure world, a claim to membership in the wider body politic.

For the Muslims too, the relationship with the Jews was valued, for the latter filled a vital economic role that made their return essential. In 1844, Jews and Muslims still believed that they existed in conditions of mutual interdependence, that the survival of one group was intimately connected to the presence of the other. Neither was yet consciously aware that the underpinnings of their longstanding pact were now in jeopardy. After 1844, the bilateral relationship inevitably became a trilateral one, as Jew, Muslim, and European became locked in a three-way struggle over power and authority. The innovation of 1844 was that thereafter, Jews would become actors in the Moroccan confrontation with the West, rather than passive observers of it.

The bombardment of 1844 shocked Jews and Muslims alike into recog- nizing they stood at threshold of an era of violent change. Patterns of behavior emerging from the crisis were repeated later in the century, as disaster in one form or another became an accepted feature of life. In 1859, Spain invaded Morocco, and the Jews of the North, including those of Tangier, were once again caught up in war. This time, the entire community left en masse for Gibraltar, in a 'rescue' aided by European Jewry. Again in 1907, during the Casablanca riots, many Jews departed for European shores. The pattern of crisis and flight was to become familiar, especially for the Jews of the port towns, loosening their ties to the larger Muslim polity. The bombardment of 1844 was the first in a series of harsh blows that would drive a wedge between Moroccan Jewry and the rest of Moroccan society.

Divisions within the Tangier Jewish community exposed by the French attack did not end with the return of the exiles. Soon the community itself became the setting for ongoing social conflict, often masked as squabbles over religious practice. In the 1860s, the 1880s, and again in the 1890s, major confrontations are documented in the community archives.42 The intra-communal strife was symptomatic of the rapid yet uneven transition Tangier's Jews were making to modernity under the influence of a growing European presence.

The role of Tangier elites in leading the exodus of 1844 was also an intimation of the future. A small yet powerful group would soon take the lead in stimulating ties with Europe and encouraging the growth of a European Jewish presence in Morocco. The first schools of the Alliance Israelite Universelle were established in the 1860s in the north of Morocco, and new ideas travelled inland to the rest of Moroccan Jewry through the avenue of Tangier. Its Westernized Jewish elite campaigned actively for the Alliance, thereby accelerating the implantation of modern ideas among a younger generation of men and women who soon numbered in the thousands.

 The primary identification of this new generation was not with Moroccan society, but rather with a world totally external to it. They saw themselves as an extension of European Jewry, where 'Jewish' was one among several categories of identity, not the ultimate definition of one's place in society. Tangier's Jews became the vanguard of a Moroccan Jewish bourgeoisie that by century's end were almost completely unhinged from the 'old' Morocco. Their preferred settings were the plush salons of the 'belle epoque', which they recreated in commodious villas situated outside of town on the plateau of the Marshan overlooking the sea. Their westward orientation set them apart – not only from most Muslims, but also from the majority of their co-religionists in the interior.

For the Jews of Tangier, and indeed for Jewish Morocco in general, nineteenth-century crises did not accelerate their integration into Moroccan society, but rather accentuated their alienation from it, as one critical event after another increased the distance between Muslim and Jew. For many of Morocco's Jews, and especially for the Jews of Tangier, the old social contract based on inherent inequality was no longer acceptable, leading them to opt out of Moroccan society by emigration and self-imposed segregation. At the same time, Moroccan Muslim society, paralyzed by its own unfortunate encounter with the West, could not muster the means to renegotiate the relationship. For Muslims and Jews alike, the crisis of 1844 was the beginning of the end of more than a thousand years of common destiny.

APPENDIX: TEXT OF THE PURIM OF THE BOMBS (translated and edited by the author)

A great miracle was made for us by our Lord, our help and our shield on the 21st of the month of Ab, in the year 5604. I will recall for you the power of a miracle. For in those days… the Kings gathered, the King of France together with the Great One Our Lord, he is our Master, and they were in a dispute.

 And it was the 7th day of the month of Ab. And we were quiet and peaceful, each one under his vine, when all of a sudden, large ships came and surrounded us off our coast, sent from the King of France to pour fire on our camp.

And on the ninth day of Ab, a day I will call a day of wrath and anger, we heard rumors saying that on that very day, war would be made on us. And when we heard it, our hearts were heavy, like a pregnant woman who approaches the time of birth. We trembled and shouted Alas! to the Lord our Father, God of Judgment, with the same sorrow as the sorrow for our destroyed temple, our splendor

 . . And our strength left us. We were frightened and a trance fell upon us. We sat there and cried. We were like a fish caught in a net, not knowing what to do. To run away and hide, or to return to our homes? We were like something floating on the sea, a stick on the surface of the water …. Our spirits were at an end, and there was no life in us.

What the ships would do was not clear to us until the 21st day of the month, when we opened our eyes and Behold! there they were, ready to make war on us. Our terror mounted, our senses were unhinged, we were weeping like a flock of sheep being led to slaughter. And we cried out that our hope is gone. We are condemned.

Barely was this said when all of a sudden a great noise reached us, shaking and breaking. A sound of fear in our ears. We heard huge stones from the furnaces of iron, called bombas falling in front of our walls like sparks from a mad boiler, like sharp arrows of death. We were all together, our wives and children, we felt like beasts. And there were those who wanted to run away and hide themselves, but they were escaping the snare only to fall into the pit, into the hands of the Ishmaelites who were sitting in our town. And those who stayed behind were running from courtyard to courtyard, from one corner to the other. Everyone was crying and their cries were great before God our Master . . . They were like grasshoppers jumping before the great noise. In one minute, forty fell. And if it had continued, it would have been like Sodom and Gomorrah … The people saw the sounds and flashing lights that came to earth on our country. We were crying out and sighing from distress in our camp, because they said that we would all die.

 In the afternoon, his mercy grew stronger and he blessed us, and our cries for help went up to God, and he got up from the seat of judgment and sat down on the seat of kindness and pity, he had mercy on our

remnant, and the rain of anger and the stones falling like meteors ceased … and the roaring stopped as if it had never been….

 And we prayed to God our Redeemer, who granted us his goodness, who makes miracles. How many bombs flew over our heads, and how many fell in front of us, and thanks to our prayers to God, not one of us was lost. The trap was sprung, we were safe, and God gave us favor and grace in the eyes of the Ishmaelites who were all around us, and they did not seize us.

 And this generation witnessed the miracle and what he did. And for this reason, the Lord made this day for rejoicing, happiness and good fortune. On sait que le nom de « Purim " est donné dans la Bible à la fète instituée le 14 du mois d'Adar (1) pour commémorer l'annulation du massacre général des Juifs qui devait avoir lieu à cette date dans toutes les provinces du vaste empire perse. Le roi Assuérus s'était laissé influencer par son vizir Haman pour ordonner l'extermination de tous les Juifs vivant dans ses domaines, mais l'intervention de la belle et gracieuse reine Esther en faveur de ses coreligionnaires sauva la situation et suscita la colère du roi contre les persécuteurs. C'est ce revirement providentiel qu'exprime dans la langue hébraïque le terme purim, plur de pur, dont le sens est « changement de sort

Cette fête, religieusement observée partout, a servi de modèle pour inspirer des commémorations similaires d'ordre local chaque fois qu'une communauté a pu sortir indemne d'une menace quelconque d'extermination au cours de son histoire.

La réaction qui se produit dans la mentalité et les sentiments des Juifs en de telles circonstances tragiques est partout la même. Suivant une vieille tradition, la génération sauvée miraculeusement de sa perte ne peut se contenter de fêter sa propre libération, mais tient à léguer à la postérité sa foi et sa confiance inébranlable dans la providence divine, qui ne manque jamais de se manifester aux moments les plus critiques, quand tout espoir semblait perdu.

C'est ainsi que nous avons vu éclore, à différentes époques des pürïm locaux en rapport étroit avec des épisodes de l'histoire d'un pays, d'une ville ou même d'une famille. L'institution d'un nouveau pürim et la façon de le célébrer sont calquées sur le modèle du Pürim national biblique.

 En général, on consigne sur une meghillah (rouleau de parchemin) le récit de l'événement, suivi de louanges à Dieu et d'actions de grâces. A chaque anniversaire, on lit à la synagogue cette meghillah, on chante ensuite des louanges et des psaumes de circonstance. on fait l'aumône, on échange des cadeaux entre parents et amis, et parfois on s'abstient même de tout travail.

La Communauté de Tanger célèbre, elle aussi, deux pürim qui lui sont particuliers: le Purïm Sebastiano ou Purïm de los Cristianos  et le Purïm de las Bombas .

PÜRÏM SEBASTIANO OU PURlM DE LOS CRISTIANOS

 Cette fête, connue aussi sous le nom de Purïm Edom, célébrée annuellement le 1er du mois d'eloul, fut instituée pour commémorer la victoire remportée par le sultan du Maroc, Moulay 'Abd el-Malek, sur Don Sébastien, roi de Portugal, à la bataille des Trois Rois, sur l'oued EI-M'kh1izen, près d'el-Qsar el-Kebir, le 4 août 1578.

 On sait que cette expédition, organisée et commandée en personne par Don Sébastien, avait pris les proportions d'une vraie croisade et qu'elle avait groupé de nombreuses forces accourues de toutes parts pour aider le Portugal à sauver le prestige de la Chrétienté en Afrique.

 Un millier de navires ayant été équipés, cette armada avait ancré dans la baie de Tanger le 7 juillet 1578. Les rangs portugais avaient été grossis par les troupes de Moulay M'hammed, neveu du Sultan et prétendant au trône du Maroc, qui s'était rendu précédemment à Lisbonne pour concerter une alliance avec Don Sébastien et le décider à cette fatale entreprise.

Quant aux Juifs de Tanger et du Nord du Maroc, les expulsions d'Espagne et du Portugal et les cruautés qu'avaient endurées leurs congénères réfugiés chez les Portugais d'Arzila étaient des souvenirs encore vivants pour eux; des cris de détresse parvenaient journellement à leurs oreilles, venant de leurs frères convertis demeurés aux prises avec l'Inquisition de l'autre côté du détroit. Enfin, la résolution affirmée par Don Sébastien de passer au fil de l'épée s'il avait la victoire tous ceux qui, parmi eux,

refuseraient d'accepter le baptême, n'était pas de nature à tranquilliser leurs âmes. Pleins d'inquiétude et de désespoir, ils jeùnèrent et firent des prières rogatoires dans leurs synagogues pour implorer la clémence divine.

 La défaite complète de Don Sébastien et de son allié Moulay M'hammed, qui s'était déjà signalé par des persécussions pendant son règne éphémère à Marrakech, quelques années auparavant, leva la menace qui pesait sur les Juifs du Maroc et fit déborder les cœurs de joie. Pour perpétuer un événement si heureux, qui passait aux yeux de tous pour miraculeux, on instaura un pürim spécial qui se célèbre encore à Tanger . L'histoire de la bataille des Trois Rois, où périt Séhastien, et les persécutions des Juifs au Maroc qui la précédèrent est brièvement racontée par un illustre contemporain, le savant grand rabbin de Fès, Rabbi Samuel Ben Sa'adiah Ibn Danan. Voici la traduction de son récit, tel qu'il figure aux pages 12 vo et 13 ro du Siddur ahabat ha-kadmonim, rituel de prières de la synagogue des Tochabim de Fès (éd. Jérusalem, 5649 [1889 J.-c.] :

 « L'année de la création La tranquillité soit dans tes palais  [5336], il s'est accompli sur nous, à cause de nos pêchés, [ la prophétie] J'étais tranquille et il m'a écrasé. Moulay 'Abd el-Màlek – que Sa Majesté soit exaltée! – vint des provinces algériennes avec une armée peu nombreuse comprenant un contingent de Turcs. Moulay M'hammed ben 'Abd Allàh le combattit et, bien que son armée fût très nombreuse et qu'elle s'élevât à environ cent mille guerriers, il fut vaincu par Moulay 'Abd el-Malek. Loué soit Celui à qui tout est révélé et qui transmue toutes les causes, car il arriva qu'un des généraux de l'armée de Moulay M'hammed se révolta contre lui. Il était un des chefs de l'armée des Andalous et s'appelait Eddeghal. Que l'impie soit exterminé! A la suite de cela, le roi Moulay M'hammed s'enfuit les reins cassés et tremblant, le deuxième soir de Pesah  et nous restâmes comme des brebis  sans berger. Puis, Moula y 'Abd el-Malek fit son entrée dans la ville  et Moulay M'hammed s'enfuit à Marrakech. Les communautés  de Fès avec leur nagïd Abraham Rute, eurent à payer alors un impôt d'environ cent quarante mille oqeya « onces », et le tribut pesa lourdement sur les communautés.

 Après cela, Moulay 'Abd el-Miilek s'en alla a Marrakech. En chemin, il eut à livrer une grande bataille a Moulay M'hammed aux environs de Salé où il perdit un nombre considérable de ses soldats et de ses généraux. Moulay 'Abd el-Malek fit son entrée à Marrakech en grande pompe. Il envoya aux rabbins, afin que cette somme fùt remboursée à la communauté, soixante mille oqeyat prélevées sur la somme que cette dernière lui avait versée auparavant; le remboursement fut fait. Cela eut lieu sous la direction du nagïd Rabbi Joseph al-Mosni.

 Ensuite la nouvelle parvint au roi que Moulay M'hammed sautait pardessus les montagnes pour venir de nouveau lui faire la guerre. Il (le roi 'Abd el-Malek) partit dans une autre direction et aussitôt après, Moulay M'hammed arriva dans la ville de Marrakech et commit toutes sortes de vengeances sur les Juifs et sur les rouleaux de la Loi. Puisse Dieu les venger! Et c'est grâce à la grande miséricorde divine que les ennemis ne pénétrèrent pas dans la qasba et ne nous exterminèrent pas tous, car peu s'en fallut qu'il ne restât rien des derniers survivants. Et on nous écrivit de Marrakech que les persécutions qui avaient été ordonnées pour une durée de onze jours ne durèrent que dix jours, que cela se passa au mois d'Adar et que la communauté, qui comptait soixante mille âmes, fut anéantie quand Moulay M'hammed se fut rendu maître de la ville. Lorsque nous apprîmes ici ces nouvelles, à la veille de Pesah, tous les cœurs fondirent et les mains s'affaiblirent. Les rabbins publièrent l'ordre aux communautés de s'abstenir de préparer des gâteaux au miel ou des mets au riz. Et je me souviens d'avoir vu feu mon père, mon seigneur et maître – que le souvenir du juste soit une bénédiction – pleurer et faire pleurer (les autres) le soir de Pesah, comme à la veille du 9 Ab, sur le désastre qui avait dévasté la ville de Marrakech. Aussitôt la Pâque terminée, les rabbins or donnèrent un jeûne et lurent de nombreuses lamentations.

Et dans cette même année plusieurs autres communautés souffrirent également de nombreuses tribulations de la part de Moulay M'hammed.

Après cela, dans l'année 5338 [1578 J .-C.], le 1er du mois de kislev, Moulay M'hammed ci-dessus mentionné fut de passage [en notre ville] un samedi, et Dieu – béni soit-Il! – nous sauva de ses mains. Il parcourut une contrée après l'autre et poursuivit ses efforts jusqu'à ce qu'il lui fût possible d'atteindre la ville de Lisbonne, la capitale, et de gagner Edom  par ses suggestions afin de le décider à venir guerroyer avec lui contre Moulay 'Abd el-Mallek. Moulay 'Abd el-Malek sortit alors de Marrakech avec une grande armée et on proclama l'ordre [de mobilisa lion] dans tous les districts de l'Empire pour aller tirer vengeance d'Edam. Et la guerre atteignit son point culminant près d'el-Qsar, sur les bords de l'oued el-M'khazen. Et. malgré la mort de Moulay 'Abd el-Malek, dont la cause ne nous est pas connue, il advint qu'une partie de ses serviteurs la tinrent secrète et proclamèrent qu'il vivait toujours.

 Dans cette journée, trois rois perdirent la vie: Moulay 'Abd el-Malek, qu'on transporta ici, où il fut enterré; Moulay M'hammed, à qui l'ont fit l'outrage d'écorcher [son cadavre] el de bourrer sa peau de paille pour la montrer dans toutes les parties du Maroc, en prétendant qu'il était encore vivant; enfin Sébastien, roi de Lisbonne, des mains duquel Dieu – béni soit-Il – nous sauva. Cette bataille atteignit son apogée dans l'année 5338 [1578 J.-c.], le second jour de la néoménie du mois d'eloul [soit le 1er eloul].

Et à cause de ce qui précède, les rabbins s'assemblèrent et acceptèrent pour eux et leur descendance d'instituer un pürïm et de faire des dons aux pauvres, depuis ce temps jusqu'à la venue du Messie notre Rédempteur. Puisse-t-il vite se révéler, ù notre époque même. Amen, et que telle soit la volonté divine!

 Depuis qu'il a été institué, ce pürïm a été régulièrement célébré par les Juifs de Tanger, le 1er eloul, date à laquelle eut lieu la bataille des Trois Rois. Dans les synagogues de la ville, le jour de cet anniversaire, on chante des louanges et des Psaumes de circonstance, et on lit une meghillah dont nous allons traduire la plus grande partie, celle qui fait le récit de cet événement:

 « Rouleau pour le deuxième jour de la néoménie du mois d'eloul de l'année Il a envoyé la délivrance à son peuple [5338].

Un grand miracle s'est produit au bénéfice des Juifs qui habitaient les diverses contrées du Maroc. La grandeur de ce miracle vient de ce que le roi de Portugal, dont le nom était Sébastien – que son nom et sa mémoire soient effacés – arriva plein d'arrogance, après de sournoises machinations, et prétendit conquérir le territoire du Maroc. Il avait rassemblé à cet effet une grande armée, une foule nombreuse comme le sable de la mer, des chevaux et des cavaliers équipés avec des fusées, tous armés d'épées aiguisées et entraînés à la guerre, des archers et des lanciers, ainsi que des armements de toute sorte.

Avec toute cette armée, il parcourut les routes de la mer dans des navires et de grands vaisseaux pareils aux flottes de Kittim  et il aborda à Tanger – que Dieu la protège! Et quand il eut débarqué dans la dite ville de Tanger, il y disposa son armée entière comprenant de nombreux généraux . et des nobles venus avec lui des contrées lointaines; c'était une grande multitude qui couvrait la surface de la terre. De là, il repartit avec toute son armée pour conquérir la première ville qui se trouvait sur son chemin et qui est el-Qsar el-Kabir ; les étendards étaient déployés, les chevaux galopaient et les chars cahotaient dans une mêlée de chants et de cris de joie.

 Et il advint que le deuxième jour de la néoménie du mois d'eloul (le 1er eloul), il campa avec toute son armée pour engager la bataille avec le roi du Maroc, qui venait combattre contre lui pour libérer son pays de son emprise. Et alors, ce fut un moment d'angoisse pour Jacob (les Israélites), parce que le méchant avait, d'un cœur superbe, fait le vœu dans la maison de son Dieu de bois et de pierre, s'il parvenait à conquérir les villes du Maroc, de faire administrer l'eau baptismale à tous ceux qui s'appelleraient du nom d'Israël, et de faire passer au fil de l'épée tous les récalcitrants. Ceci nous fut annoncé par deux Juifs convertis de force. Ils étaient venus avec ses troupes; ils nous dirent: « Priez votre Dieu qu'Il ait pitié de vous. » – Et nous priâmes pour nous le Saint, béni soit-Il ! Et il se souvint de nous ainsi qu'Il nous l'avait promis par l'entremise du Prophèteque le salut soit sur lui – dans les termes que voici: « Néanmoins, lorsqu'ils seront dans le pays de leurs ennemis, je ne les rejetterai point ni ne les mépriserai jusqu'à les laisser périr entièrement et rendre vaine l'alliance que j'ai faite avec eux, car je suis le Seigneur, leur Dieu. » Et il est dit aussi: « Je me souviendrai en leur faveur de l'alliance que J'ai faite avec leurs ancêtres, que J'ai fait sortir du pays d'Egypte à la vue des nations pour être Moi-même le Seigneur, leur Dieu. »

 Et tout à coup, en cette même journée, ils se déconcertèrent et perdirent courage; leur armée trembla. C'est là qu'ils virent leur fin et qu'ils furent exterminés dans la terreur; là tombèrent le méchant et tous les chefs de ses troupes, et toute cette armée subit la terreur divine. Malgré leur fuite, personne ne put se sauver, car ils tombèrent tous entre les mains des Berbères. Louanges à Dieu, béni soit-Il! Et parce que Dieu fit cette journée, égayons-nous et nous réjouissons en elle. Les Juifs, rabbins et notables qui vivaient à cette époque instituèrent pour eux et pour leur prospérité, ainsi que pour tous ceux qui viendraient se joindre à eux, la commémoration annuelle de cette journée en faisant l'aumône aux pauvres, en célébrant un jour de festin et de joie, en fermant les magasins et en s'ab~tenant de tout travail. Et quand Dieu retournera à Sion, Jacob se réjouira et Israël sera content. Alors notre bouche se remplira de joie et notre langue d'allégresse 

 La seconde partie de cette meghillah ne présente aucun intérêt historique. Elle commence par une citation biblique (Isaac, LXIII, 7, 8 et 9) et se termine par une série de louanges et de remerciements à Dieu extraits de la Bible. Pour finir, nous devons signaler que le pürim en question a été étudié un peu à la légère par feu José de Ezaguy dans 0 minuto victorioso de Alcacer Quibir (Lisbonne; 1944, p. 73 sq.). Dans le chapitre qu'il consacre au débarquement portugais à Tanger, il fait allusion à notre meghillah et·en donne une interprétation erronée qui s'est attiré une mise au point bien justifiée, de la part de notre bon ami, Don Francisco Cantera Burgos, le docte professeur de l'Université Centrale de Madrid, directeur de l'Ecole d'études hébraïques et du Proche-Orient (Consejo superior de investigaciones cientificas .

פרקים בתולדות הערבים והאסלאם-עריכה חוה לצרוס-יפה-היהודים בארצות האסלאם

תקופת מוחמד

אך יחסי השכנות הטובה ששררו בין יהודי ית׳רב ובין השבטים הערביים אשר השתכנו בה, נתערערו זמן קצר לאחר הגירתו של מוחמד אליה. המאבק הבלתי־נמנע בין מוחמד לראשי השבטים היהודיים, ובעקבותיו בין האסלאם המתפתח ולובש צורה מוסדית־ארגוגית ובין היהדות, גרם לעבירת היחסים. החלה ניכרת איבה גוברת והולכת בין מוחמר ונאמניו שבאו אתו ממכה ו״עוזריו״ באלמדינה, לבין יהודי ית׳רב. מעשי האיבה התחילו בהאשמת היהודים בזיוף התורה ובהוספת תוספות עליה. לאחר מכן באו מעשי רצח של שונאים בודדים, ולבסוף גירוש שני שבטים יהודיים — לראשונה בני ק י נ ק א ע החלשים ואחריהם בני נדיר, וטבח השבט השלישי — בני קר י ט׳ ה (ראה פירוט הדברים בפרק ב׳).

בשעת גירוש בני נדיר, אחד השבטים היהודיים הגדולים באלמדינה, על־ידי מוחמר, הצטערו על כך שכניהם הוותיקים והביעו את צערם בגלוי. אך היו גם ערבים שאמרו, כי אין לבכות על גורל היהודים: הם אויבי שליח אללה ועל כן התיר האסלאם את רכושם ודמם. בכל זאת נמצאו ערבים, שהיו מבכים בשיריהם את גירוש ידידיהם היהודים והרימו על נס את נדיבות רוחם ולבם, גם הזכירו את הטובות והחסדים שהיו היהודים גומלים עם הערבים ואת כפיות־הטובה של אלה כלפי מטיביהם. ברור שדברי הקוראן והדברים המיוחסים למוחמד ולחבריו הקרובים במסורת שבעל־פה השפיעו את השפעתם וסופרים מוסלמיים היו משתמשים בהם כדי ללבות את השנאה ליהודים ולהרעיל את האווירה בחוגים קנאיים של החברה המוסלמית. אולם מצד שני יש לשקול גם עובדות אחרות. עם תום מלחמתו בשכניו היהודים באלמדינה, קבע מוחמר עצמו נוהג חדש עם יהודי ח׳יבר בזמן הקרבות ובתנאי הכניעה שערך עמהם ועם הישובים היהודיים באלחג׳אז הצפונית ובאיזור הספר של ארץ־ישראל. תנאי כניעה אלה, שהיו שווים ליהודים ולנוצרים, שימשו מסורת־הלכה קובעת ומחייבת לכל ההסכמים שנעשו עם היהודים והנוצרים בארצות הכיבוש. בהתאם להם היה מעמדם של היהודים והנוצרים אמנם נחות, אך מוגן היטב, תמורת התשלום של ה״ג׳זיה״, מס הגולגולת, שנקבע בקוראן עצמו (סורה 9, 29). ההקפדה על הגנתו של ה״ ד׳ מ י״, איש החסות הלא־מוסלמי המשלם את ה״ ג׳ ז יה״, היתה מצווה מחייבת את הכלל ואת הפרט, את השלטונות וכל יחיד.

היהודים בימי הכיבושים

במסע הנצחונות של שבטי הבדווים, שהתחיל כשנתיים לאחר מות מוחמר, נתקלים הם בכל ארץ, שאליה הם מגיעים, בעדות יהודיות קטנות וגדולות, המושרשות באיזור מזה מאות שנים. מעמדם המדיני והחברתי של היהודים נתערער בשעה שהדת הנוצרית נעשתה השלטת באסיה הקטנה, בסוריה וארץ־ישראל, במצרים ואפריקה הצפונית. הקיסרים הביזנטיים הוציאו פקודות ותקנות, שלפיהן נאסר על היהודים לשמש בתפקידים ציבוריים, מאחר שעל־ידי כך תהיה להם שליטה על נוצרים, ולהקים בתי־כנסת חדשים. באפריקה אף פקד יוסטיניאן להרוס את בתי־הכנסת הקיימים, וכן אסר ללמוד וללמד את התורה שבעל־פה. כמו כן עמדה בתוקפה גזירת המס על היהודים מימי חורבן הבית, אשר הפך למס גולגולת. עול המסים הכבד בלאו הכי (שגרם כבר בתקופה זו, כבתקופה המוסלמית לאחר מכן,לעזיבת הקרקע) הכביד כפליים על יהודים. ואחרון אחרון חמור היו גזירות השמד שנתנסו בהן היהודים ביובל האחרון של השלטון הביזנטי. ולא היתה זו נחמה ליהודים, שגם הנוצרים, אשר לא השתייכו לכנסיה האורתודוכסית, נטלו את חלקם בנגישות, בסבל וביסורים מידה הקשה של הכמורה הקנאית בקונסטנטינופול ,ומידי עושי דברה, השלטונות החילוניים.

גם במלכות פרס לא שפר אז מצבם של היהודים. במאה וחמישים השנים האחרונות של שלטון שושלת הסאסאנים עברו גם על החברה היהודית בבבל זעזועים חמורים, שעירערו את מוסדות התורה וההנהלה האוטונומית. סמוך לזמן הופעתו של מוחמד במכה ערכו הפרסים התקפה עזה על ביזנץ וחדרו עמוק לשטחיה. אז התקוממו יהודי אנטיוכיה נגד הביזנטים, הרגו את הפאטריארך ובכך עזרו בעקיפין לכיבושה על־ידי הפרסים. אך התקוות שתלו יהודי ארץ־ישראל בפלישתם של הפרסים לארץ, ובכיבושה של ירושלים על־ידיהם, נתבדו, אם כי הותר אז ליהודים לחזור לפרק זמן קצר לירושלים. הצבא הפרסי, שמסע הכיבושים שלו הפך לפתע לנסיגה מבוהלת, נאלץ לנטוש את ארץ־ישראל. הכמורה הנוצרית נקמה את נקמתה ביהודים, אף כי הראקליוס קיסר הבטיח להם חנינה.

במדרשים היהודיים שנוצרו בימים ההם משתקף מתח התקוות המשיחיות שגברו באותו דור. הדים להן אפשר למצוא גם בסיפורים הערביים על חסידים ונביאים שהופיעו בערב, ושהם קשרום עם הופעתו של מוחמד. באווירה זו של תקוות ואכזבות אין לתמוה על כך שהיהודים עקבו בנשימה עצורה אחר התפתחות המלחמה בין בגי ישמעאל ובני אדום.

להבנת עמדתם של היהודים באותו דור מעניינת ביותר היא שאלתו ההססנית של המדרש האפוקאליפטי ״נסתרות דר׳ שמעון בן יוחאי״, שחובר באותו זמן, והתשובה שהושמה בפי מטטרון: ״כיוון שראה מלכות ישמעאל שהיה בא התחיל בוכה ואומר: לא דיינו מה שעשתה לנו מלכות אדום הרשעה, אלא אף מלכות ישמעאל ? מיד נגלה אליו מטטרון שר הפנים ואמר לו: אל תירא בן אדם, שאין הקדוש ברוך הוא מביא מלכות ישמעאל אלא כדי להושיעכם מזאת הרשעה״.

לפיכך אין פלא בדבר, שלא רק מקורות נוצריים, החשודים בהגזמה ומגמתיות, אלא גם ההיסטוריון הערבי אלבלאד׳רי, שתיאורו את מסע הכיבוש הערבי נחשב כמהימן ואובייקטיבי, מרבים להזכיר את העזרה שהגישו היהודים לערבים בזמן הכיבוש, ובמיוחד בחדירתם לערים הבצורות בסוריה, בארץ־ישראל ובמצרים, כגון: מוצל, חמץ, קיסריה, אלכסנדריה (וכן בספרד). בשל אמונו ביהודים הושיב אותם מעאויה בטריפולי. לעומת זאת מוסרת כרוניקה סורית, כי בקרב בין הביזנטים לבין הערבים, שנערך בשנת 634 במרחק קטן מזרחית לעזה, השתתפו דווקא בצד הביזנטים גם כפריים יהודים עניים. גם הסיפור על ה״כּאהנה״, מנהיגת הברברים המתייהדים, שנלחמה בכובשים הערביים באפריקה, הוא אופייני לנטייה זו, אף אם הוא אגדה.

מותר להניח כי תיאורי שיתוף הפעולה מצד היהודים עם חיל־הפולשים נכונים בדרך כלל, אף אם יש בהם הפרזות. סוף סוף אין המקורות הנוצריים מצליחים להסתיר, כי גם האוכלוסיה הנוצרית בסוריה ובמצרים, שלא השתייכה לכנסיה השלטת, ראתה בערביים מצילים מידי אדונים קשים ועול מסים כבד. חיש מהר נודע, שהערבים מקפידים על שמירת ההתחיבויות שקיבלו על עצמם בזמן כניעת התושבים, ודבר זה שימש תעמולה יעילה לטובתם.

תכשיטים אצל נשות מרוקו

תכשיטיהן של הנשים היהודיות במארוקו היו כמעט זהים לאלה של הנשים הערביות או הברבריות. למעשה, רק בדרך ענידתם היו הבדלים, וייחודה של דמות האישה היהודית היה בעיקר במעטה ראשה, כפי שתואר ביתר הרחבה בדיון בתלבושות.

בערים היו רוב התכשיטים עשויים זהב, ומשקל הזהב של התכשיטים שימש עדות לעושר המשפחות. העדיים העתיקים שהתהדרו בהם הנשים היהודיות והערביות בערים מקורם בספרד, בדומה לתלבושות.

הנשים היו עונדות לצווארן את ענק־השושניות (״תאזרה״), ולאוזניהן — עגילי־תליונים (״כראסעמארה״); כן היו עונ­דות עגילי־טבעת עם תליונים(״דוואה״) ותליון ארוך (״זוואג״). בעיצוב התכשיטים היה לכל עיר סגנון משלה. כך, למשל, אפשר למצוא במדאליונים עתיקים שושניות העשויות תשליבים ופיתולים, המזכירים את הסגנון הספרדי־המאורי. השושניות במדאליונים המאוחרים יותר משופעות באבנים טובות ובפנינים. ההשפעה הספרדית בולטת גם בשם שניתן לציץ הפרח של הרימון — ״ררנאטי״ — המופיע תדיר בהיותו משובץ אבני אזמרגד, אודם ואגרנט.

הערת המחבר:  נוסע מן המאה הי׳׳ט, הודג׳קין, שליווה את סיר משה מונטיפיורי במסעו למארוקו, מציין, כי נשים יהודיות אהבו במיוחד אבני־אזמרגד, כפי שמעיד גם ריבוי האבנים האלו בתכשיטים שבידנו.

על זרוען של נשים יהודיות ראיתי לא אחת צמיד צלעוני מקסים של כסף וזהב לסירוגין, שניתן לו השם הציורי ״שמש וירח״. גם מצאתי את המוטיב הנדיר של הציפור, שעיטר בעבר את מיגוון הטבעות העירוניות העתיקות הקרויות ״טבעת הציפור״; את כל הצורות של כף־היד, ה״כמסה״ — שהיא סגולה לאושר ולמזל טוב — מסוגננת פחות או יותר; וכן צמידים רחבים ומקומרים, עתים מלאים ומשובצים באב­נים עתים מעשה־קידוח כעין התחרה. לצמידים אלה מיתוספים לעתים קרובות שבעה חישוקי־זהב דקיקים, הקרויים ״סמאנה״ על שום מספרם, שהוא כמספר ימות השבוע (semaine). עוד ראוי לציין את החיבה המיוחדת שנודעה למחרוזות־הפנינים בשל סגולתן המבורכת בעיני הנשים היהודיות.

בשנות השלושים והחמישים עלה בידי לבדוק את תכשיטי־הזהב שהצטברו אצל הצורפים היהודים בערים. כל התכשי­טים הם מעשי ריקוע, חיקוק וחירור, ועל־פי־רוב הם מעוט­רים ביהלומים. הצורפים לא היו עוד נאמנים לטכניקות המסורתיות, אך עם זאת השכילו להוציא מתחת ידם את ה״תווייז׳״המפואר, הלוא היא העטרה העשויה לוחיות על צירים; את ה״פקרון׳ (צב), שהוא אבזם עדין של חגורה מלאכת־מחשבת; את ה״טאבּע״ (חותם), שהוא עדי־המצח המסורתי; ואת האחרונה שבסידרת העדיים החדישים, הב­אה במקום ה״מצממה״ העתיקה, הלוא היא חגורת־הזהב העשירה, העשויה פרקים־פרקים של לוחיות־זהב מעשה חירור.

התכשיטים הכפריים משנים צורה בהתאם לאזורי הארץ. הם לעולם עשויים כסף; לכל תכשיט מיגוון עשיר של דוגמאות, בהתאם לטעמו של כל שבט.

באטלאס העילי ובמורדות המשתפלים לעבר הסאהארה אמנם אפשר למצוא לעתים מוטיבים עיטוריים המעידים על השפעות קדומות ביותר, אולם באיזור מול־האטלאס, שנשאר ערש הצורפות המעולה, רווחות בעיקר הצורות והטכניקות שהורישה אנדאלוסיה של ימי־הביניים. ואכן מצאתי במקום תכשיטים רבים המוכיחים את אמיתותה של סברה זאת, מה־גם שצורותיהם נלקחו מעדיים ספרדיים שזמנם חופף בדיוק את גלי חדירתן של המסורות היהודיות שהביאו מגורשי ספרד לאיזור זה, חדירה שעל עקבותיה גם עמדנו בתיאור תלבושות הנשים.

מרכז חשוב מאוד של צורפים יהודים היה בטהלה — כפר קטן בלב־לבו של מול־האטלאס, בקרב השבט הגדול של בני- אמלן. לפני שעזבו את המקום בשנות החמישים חיו בכפר זה כמה משפחות, שמסרו מאב לבן את סודות אומנותם. לא הרחק משם, במרומי ההר, בכפר טיזי אמושיון, היה מרכז האומנים הברברים, ומעניינת העובדה, שנעשו בו תכשיטים זהים בתכלית לאלה שנעשו במרכז היהודי שבטהלה.

במרכזים כפריים אחרים היה ניוון רב בשנים האחרונות. בעמק הזיז, למשל, החליפו לאחרונה את עדיי־החזה ואת העטרות בשרשראות שמושחלים בהן מטבעות־כסף וחרוזים צבעוניים.

הגעגוע חזק מן המשחק

שיחקתי בחוץ עם חברי במשחק "חמור חדש" בו השתתפו ילדים מגילאים שונים . הקטנים קפצו תחילה זה על גב זה ואחר כך כופפו גוום ונצמדו בטור זה לצד זה. בהדרגה התארך הטור של ה״חמורים" שמעליהם קפצו היותר גדולים. ככל שהיו יותר ילדים כך התארך הטור שעליו התחרו הילדים הגדולים בחבורה , ואילו אנחנו הקטנים עמדנו זמן רב בתנוחה של גב כפוף והידיים אוחזות בברכיים ורק הראש יכול לפנות ימינה או שמאלה כדי לראות את הילד הבא בתור רץ ומנתר, ואחר כך להפנות את הראש לצד השני כדי לראות אם הצליח לעבור מעל כל "החמורים הקטנים" או שמא נחת בחבטה על גבו של "חמור" מסכן …

בתנוחה זו של המתנה ארוכה לסיום משחק ה״חמורים" , נתקפתי לפתע בגעגועים עזים לאבי, ששכב כבר מספר ימים בבית החולים. אמרתי לחבר שעמד לצידי להתקדם מפני שעלי לצאת מן המשחק. מבלי להשתהות , רצתי ושאלתי עוברים ושבים כיצד להגיע לבית החולים. לבסוף כשהגעתי לשם מצאתי את שער הכניסה סגור.

היה כבר חשוך מסביב ורק השומר צעד בצעדים מדודים מקצה אחד של השער אל קצהו השני. התקרבתי לפינה אחת של השער וכאשר השומר הפנה את פניו לצד השני , זחלתי מתחת לשער ורצתי אל הבניין הקרוב. לא ידעתי היכן החדר של אבא עד אשר אחד החולים עזר לי למוצאו. כאשר ראיתי את אבא, רצתי אליו וחיבקתי אותו חזק. אבא קיבל אותי בשמחה , ליטף את ראשי ושאל בחיוך:

  • איך הצלחת להתחמק מן השומר בשער ?

תוך כדי דיבור הוציא סדין לבן מן הארונית , פרש אותו לידו והציע לי לעלות למיטה. בשמחה חלצתי את נעלי והתיישבתי לצידו . אבא פתח קופסה של עוגיות פריכות , מאלה שאמא אפתה לו. הייתי אכן רעב ועייף מן היום הארוך. אבא קרא לאח התורן , תחב משהו לידו , אולי פתק עם הכתובת שלנו , אולי זה היה כסף ואולי שניהם גם יחד ואמר לו :

  • בבקשה ממך והאל יברך אותך , לך תודיע בביתי שלא לדאוג לילד הצעיר וכי הלילה הוא יישאר לישון עם אביו .

נעם לי מגע היד המלטפת של אבי עד אשר נרדמי.

למחרת בבוקר אבא קרא שוב לאח התורן שזה עתה סיים משמרתו וביקש ממנו ללוות אותי הביתה. זו היתה חוויה שנחרטה עמוק בזכרוני . כמובן שמחתי שאבא השתחרר כעבור זמן קצר , כך שיכולתי שוב להאזין לסיפורים שלו כפי שנהג לספר לי לאחר הסעודה השניה של שבת.

משחקים בבית

בבית יכולתי לשחק עם אחותי "רונדה" , שהוא משחק קלפים בעלי שמות בספרדית כמו למשל , למספר ארבע קראו "קוּאָטרו" ולמספר חמש – "סינקו". שיחקנו בקלפים "מלחמה" או עשינו "סדרות" וכל המרבה , הרי זה משובח, כלומר , מנצח.

בשעה שאחותי רקמה על גובלֶן שהיה מתוח בין שני עיגולים מעץ, יכולתי להכין הליקופטר עשוי מגלעין של מישמש , בו נקבתי חור משני צידי הגלעין כדי להשחיל מסמר עד קצה ראשו ובקצהו השני נעצתי חצי אטב כביסה עשוי עץ . כאשר לופפתי חוט מסביב למסמר ומשכתי אותו בחוזקה , היה ה״פרופלור", כלומר חצי האטב, מסתובב ומזמזם.

משחק אחר שהכנתי היה ״ הַמַכְבֵּש" אותו הכנתי מסליל חוטים עשוי מעץ ושקצותיו היו רחבים . בתוך הסליל החלול הכנסתי גומייה אשר הקצה האחד שלה היה תפוס בעזרת חצי גפרור והקצה השני של הגומיה היה תפוס בעזרת גפרור שלם שחלקו בלט מעט משפת הסליל. כאשר סובבתי את הגפרור הארוך , נמתחה הגומיה עוד ועוד , וכאשר הנחתי את הסליל על השולחן הוא התחיל לנסוע ולהתגלגל כמו מכבש.

בילויים מיוחדים

היו לנו פעילויות שהיו תלויות בהוצאה כספית , כלומר, היינו תלויים ברצון ההורים, למשל ללכת לתיאטרון בובות או לקולנוע. במקרה זה לא נזקקנו , אחותי ואני ,למתן הסברים. ההורים ידעו ורצו שנהיה עם הילדים היהודים הרבים שגדשו בכל יום ראשון בצהר״ם את בית הקולנוע "מטרופול" הסמוך לביתנו או לתיאטרון הסמוך לבניין העירייה. לעומת זאת , לפעילויות נוספות נאלצנו להשתמש בכסף שחסכנו ואגרנו בקופת העץ הפרטית שבנינו אצל הנגר.

פעם בשנה היה מגיע לעיר הקרקס "מדרני", שזו הייתה חוויה בלתי רגילה. התפעלנו מן האוהל הענק, מופע הליצנים, האקרובטים ומן החיות המאולפות. הצטרפנו למחיאות הכפיים לאחרי כל קטע של מופע ולפעמים שאגנו "ביס"! "ביס"! כלומר יעוד הפעם !… לאחר המופע היו לנו תמיד ויכוחים אם למשל הדוב שרקד לצלילי המוסיקה היה דוב אמיתי או שמא בן אדם הלבוש בעור של דוב, או למשל האם הבחורה שעפה מן הלוע של תותח הייתה אמיתית או שמא זו הייתה בובה בלבוש של אקרובטית….

מחוץ לאוהל הענק היו דוכני משחק ודוכני הגרלות , גלגל ענק ומתקני שעשועים כמו מכוניות חשמליות מתנגשות או קרוסלה עליה הסתובבו ילדים רכובים על סוסי פוני מעץ. הייתה שם גם צלמנייה קטנה בה אפשר היה לבחור תחפושת ולהצטלם בתשלום. בביקור האחרון של הקירקס בעיר , הספקתי להצטלם עם חברי לכיתה כשהוא מחופש לאינדיאני המאיים עלי בסכין ואילו אני בבגדי קואבוי אוחז בשמאלי את ידו המונפת והמאיימת ובימיני מכוון כנגדו אקדח צעצוע. שמרתי את התמונה למזכרת ואף הספקתי להראות אותה לחברי החדשים בישראל . מאז איני מוצא אותה.

אהבנו ללכת בקיץ לחוף הים רחב הידיים שהמה תמיד באנשים , נשים וטף. אהבנו במיוחד ללכת לשם בימים בהם התקיימו בחוף פעילויות נושאות פרסים כמו למשל בניית חומות ומגדלים סביב לטירה , או מנהרות, תעלות מים וסירות קטנות מנייר, או פסלים שונים מחול ועוד.

בקיץ האחרון, לפני שעלינו לישראל הגיעו אלינו בני הדודים מקזבלנקה. בּובּ , הבן הבכור של הדוד שמעון ודויד הבן הבכור של הדודה טרז . צפינו במשחק שעשועים כמו למשל בבחורים שהתחרו בטיפוס על עמודים משוחים והתמוגגנו לראותם מחליקים ושוב ושוב. תחרות אחרת הייתה לפצח כדים שהיו תלויים על חבל קשור בין שני עמודים בשעה שעיני המתחרים היו קשורות. פרצנו בצחוק בשעה שמתחרה היכה בטעות מתחרה שנקרה בדרכו.

נכנסנו גם לים. באחת הפעמים שנכנסנו למים התרחקנו ואני נאלצתי לעמוד על קצות רגלי. לפתע בא גל גדול שדחף והפיל אותי. אז טרם ידעתי לשחות וחשתי שאני עומד לשקוע במים. לפתע הרגשתי שתי ידיים מתחת לגופי מושות אותי כלפי מעלה ומעמידות אותי על רגלי. אחרי מעשה הטוב של בּובּ החלטתי שעלי ללמוד לשחות ללא דיחוי.

מקדם ומים כרך ו' –חיפה 1995 -דניאל שרוטר ויוסף שרוטר-הרפורמה במוסדות היהודיים במרוקו

ההתייעצויות החדשות נסבו במיוחד על עניין בית הדין הגבוה ומינוי דיין בעל מוניטין שיעמוד בראשו. מבחינת הפרוטקטורט נדרשה ערכאה חדשה זאת כדי לפקח על רמת הדיינים וטיב הכשרתם וכדי להביא את הערעורים על פסקי דין הלכתיים בפני ערכאה יהודית ולא מוסלמית, כדי שלא לערב את הסמכות הפוליטית של הסולטן עם הסמכות הדתית שלו כראש המאמינים המוסלמים במרוקו. נימוק נוסף שהועלה הוא, שאב בית הדין הגבוה יוכל לשמש גם רב ראשי לכלל הקהילות היהודיות במרוקו, שקודם לכן לא היו כפופות לסמכות מרכזית, ישמש מעין נציג שלהן ויבוא במקום האספה הכללית של יהודי מרוקו. רעיון האספה הכללית שהועלה בתכנית סלושץ היה עלול לדעת ראשי הפרוטקטורט, לעודד את הפוליטיזציה של יהודי מרוקו.

למפקדו ולליוטה בעניין קידום מעמדם של יהודי מרוקו וניצול אהבתם לצרפת, בתוך אד״צ/מרוקו, מע״ש, תיק וסו. במכתבו לליוטה מן ה־5 במאי 1918 הוא מעלה הצעה מקיפה לרפורמה חברתית־ תרבותית בקהילות היהודיות, ובמיוחד בקרב הנוער היהודי, שתקרב אותו עוד יותר, לטענתו, לערבים של צרפת. ראה שם.

עם תום החקירות וההתייעצויות פורסמה הרפורמה העיקרית הראשונה בסוף מאי 1918 מעל דפי העתון הרשמי של הפרוטקטורט בצורת צ׳היר שנחתם בידי הסולטן ב־22 של אותו החודש. בפקודה זו הוגבל תחום אחריותו של ועד הקהילה לניהול העניינים הדתיים, ארגוני הצדקה ונכסי ההקדש. הוועד כלל מספר נכבדים שהתמנו בידי ראש הממשל המרוקאי (״הווזיר״ הראשי״ שעמד בראש המח׳זן) מתון רשימות שהציגו הקהילות, מספר שונה בבל קהילה על פי גודל האוכלוסייה היהודית. משמעות הדבר הייתה אישור המינויים בידי השלטונות הצרפתיים. הוועד, שכלל מארבעה עד עשרה חברים, מונה לשנתיים, עם אפשרות לחידוש כהונת חבריו. הצ׳היר גם אפשר לשלטונות הפרוטקטורט לפקח במישרין על חיי הקהילות באמצעות המפקח על המוסדות היהודיים, שמונה בידי מנהל העניינים השריפיים. הטעם הרשמי לארגונן מחדש של הקהילות היה קידום המודרניזציה של המוסדות המסורתיים, אך התוצאה למעשה הייתה הכפפתן של הקהילות לשלטון הקולוניאלי בלי לספק להן את האמצעים להתאים את עצמן לשינויים הדרושים.

אשר לבתי הדין הרבניים, הם שמרו מאז ומתמיד על מידה רבה של שליטה בענייני הקהילות היהודיות, על אף התחרות שהתחרו בהם מערכות שליטה אחרות. בית הדין הוא גם שקבע את מעמד האוטונומיה הפנימית היהודית יותר מכל מוסד יהודי פורמלי אחר. הכוונה ברפורמה שנקבעה בפקודה של 1918 הייתה קודם כול להקים ביורוקרטיה משפטית חדשה שהשלטון הקולוניאלי יוכל לפקח עליה בקלות ולהגביל את סמכות בתי הדין הרבניים לתחומים של דיני אישות וירושות; לשם השוואה, הצו של אוגוסט 1913 הגביל את סמכות בתי הדין היהודיים לעניינים דתיים: נישואין וגירושין, ירושות, מוסדות צדקה, ניהול בתי הכנסת וכו'. על פי הצ׳היר של 1918 הוקמו בהתחלה ארבעה בתי דין ראשיים במרכזים העירוניים החשובים ביותר שהיו תחת שלטון צרפת — קזבלנקה, פאס, מראכש ומוגדור — ומונו חמישה דיינים יחידים במרכזים אחרים מאוכלסים פחות: רבאט, סלא, סאפי, מזגן ומכנאס. בתי הדין כללו שלושה דיינים, שאחד מהם שימש כאב בית הדין, וכן מזכיר בית דין; כולם קיבלו את מינוים ואת משכורתם מידי השלטון הצרפתי. כן הוקם בית דין רבני גבוה ששימש בית דין לערעורים, מושבו ברבאט, והדיין שעמד בראשו נחשב כרב הראשי של יהודי מרוקו. בתי הדין הושמו תחת פיקוחו של המפקח על המוסדות היהודיים, שהיה חלק מן המנהל המרכזי של הפרוטקטורט. הם הורשו לנהל את פנקסיהם בעברית, אך היה עליהם להציג רישום של דיוניהם בצרפתית בסוף כל חודש לווזיר הראשי.

איך בוצעו הרפורמות בקהילות השונות הלכה למעשה? האם הן הפכו על פיהם את סדרי הקהילה ומסורותיה? גם לאחר מימושן של הרפורמות המשיכו היהודים להזדקק להכרעה או לשירותי הבוררות של הדיינים אף בעניינים שהיו מעתה מחוץ לסמכותם של בתי הדין הרבניים. פקיד הפרוטקטורט הצרפתי(le contrôleur civil) במכנאס כתב בשנת 1919: ״אכן, הם נוטים להביא את כל ענייניהם בפני הרייך מה שגרם להקמת מדינה בתוך המדינה״. על מידת הרגישות של פקידי הפרוטקטורט לעצמאות הדיינים יעיד המקרה שלהלן: אב בית הדין של פאס שלח מכתב לדיין של מכנאס וביקש ממנו לקרוא בבתי הכנסת את התקנות של בתי הדין, שהגבילו את סמכותם לענייני אישות וקבעו שיש להביא ענייני מסחר ורכוש בפני הקאדי או הפחה. פקיד הפרוטקטורט הסכים עם מטרות פנייתו של הדיין מפאס, אך העמידו על כך שפנה במישרין שלא כדין לעמיתו ממכנאס, ועקף בכך את פיקוחם של השלטונות הצרפתיים. כדי למנוע מקרים דומים שלח ליוטה צו לכל הרשויות המקומיות ודרש מהן לדאוג לכך, שכל התכתבות בין חברי בתי הדין תועבר באמצעות השלטונות הצרפתיים.

תהליך ביצוע הרפורמות בקהילת מוגדור מאלף הן מצד מידת התערבותם של הפקידים הצרפתים המקומיים בניהול חיי הקהילה והן מצד מידת השפעתן של הרפורמות על מסורות הקהילה.

Voici pourquoi il a été institué; lors du bombardement de la ville par l'escadre française, sous les ordres du prince de Joinville, le 6 août 1844, aucun dommage ne fut subi par la Communauté. Ce pürim a donc pour raison d'être une action de grâces afin de remercier Dieu que les Juifs de la ville soient sortis indemnes de ce bombardement, et qu'en outre aucun désordre n'en soit résulté.

Toutefois il faut signaler qu'à l'occasion de ce bombardement, deux incidents se produisirent; ils sont sans grande importance d'ailleurs, mais ils méritent qu'on y fasse allusion parce qu'ils ont été conservés par la tradition locale. Cette tradition rapporte comment deux personnages bien connus échappèrent miraculeusement à la mort. L'un, David Azancot, drogman du Consulat de France, qui avait pris part aux discussions entre le représentant de la France et les autorités chérifiennes, et sur lequel ces dernières fondaient leurs espoirs pour régler l'incident; l'autre est le rabbin Messod Cohen, fondateur de la synagogue qui porte encore son nom et horloger attitré des mosquées de la ville. Lorsque les pourparlers prirent fin par la rupture des relations entre la France et le Maroc, David Azancot avait reçu la mission de se rendre à Cadix pour assurer le ravitaillement de l'escadre française. Il se sauva brusquement des mains des douaniers marocains, lesquels avaient reçu l'ordre d’empêcher son départ, et il put gagner une chaloupe qui le conduisit à bord du vaisseau amiral. Là, il s'étendit, recru, sur une chaise longue, sur le pont du navire et, vaincu par le sommeil, il vit en rêve l'apparition d'un saint vénéré à Tanger, rabbi Messod Buzaglo, qui lui disait: « David, lèvetoi! » Réveillé en sursaut, il vit devant lui un officier d'ordonnance de l'amiral qui venait lui dire gentiment: ;, Monseigneur vous demande. » David se précipita hors de son siège pour se rendre auprès du prince de Joinville. A peine venait-il de quitter sa place qu'un boulet, lancé par la batterie du port, vint mettre en pièces la chaise qu'il avait occupée. Quant au Rabbin Messod Cohen, on raconte qu'au moment de fermer les volets de sa chambre, un projectile, rasant les murs de près, lui emporta juste deux doigts d'une main. A part ces deux incidents, que le peuple tint pour miraculeux, personne n'a laissé à Tanger d'autre récit écrit sur le bombardement de 1844 : il n'y a donc comme document que la meghillah qu'on lit dans les synagogues de la ville le jour du Pürim de las Bombas; cette lecture est suivie des louanges et psaumes de circonstances. Ce document reflète la grande inquiétude où se trouvaient les habitants de la ville et particulièrement les membres de la communauté juive devant les dangers qui les menaçaient. Voici la traduction de la première partie, celle qui intéresse notre sujet:

 Dans le temps, il n'y avait pas d'horloger musulman dans la ville el malgré leur intransigeance, les Musulmans devaient se résigner a admettre la présence de Rabbi Messod dans les mosquées chaque fois que ses services étaient nécessaires.

 (2) Ses descendants ont continué a etre les fournisseurs officiels de la marine de guerre française à Tanger jusqu'à ces dernières années.

« Rouleau pour le 21e jour d'ab, moisde miséricorde de l'année Bien-être certain pour Israël  de la création.

 « Des miracles et des merveilles furent accomplis en notre faveur par le Seigneur Dieu, notre Secours et notre Bouclier, le bien Certain  d'ab, mois de miséricorde. Son nom étant Menahem, il nous servira de consolation. »

Nous vous rapporterons la puissance du miracle dont je me souviens. Dans ce temps et dans ce moment, il arriva que des rois se réunirent  : le roi de France et notre grand Seigneur, notre souverain, se présentèrent en justice au sujet d'un différend.

 » Et il advint que le 7e jour du mois précité, pendant que nous étions tranquilles et en sécurité chacun sous sa vigne, voici que, près du rivage et dans le port, de grands navires et de grandes frégates nous cernèrent et nous entourèrent en nombre considérable, expédiés par le roi de France pour nous assiéger dans notre camp.

» Et la journée du 11, je l'appellerai jour cruel,jour de furie et jour de dispute. En ce jour, nous apprîmes la nouvelle que pour cette même journée la bataille avait été organisée contre nous. Nos cœurs fondirent et, pareils à la femme enceinte qui approche de sa délivrance, nous fumes pleins de souffrance. Nous clamâmes devant l'Eternel, Dieu de nos ancêtres: « 0 Seigneur, notre Dieu, il nous suffit de porter le deuil de notre Sanctuaire détruit; que ce [nouveau malheur] ne soit pour nous que chancellement, achoppement et rappel de notre iniquité. » Notre force s'affaiblit et, dans notre attente, la torpeur s’empara de nous; « c'est là que nous nous assîmes et aussi que nous pleurâmes  ». Comme des poissons dans un filet, [ainsi] nous fûmes attrapés. Nous ne savions pas si nous devions fuir pour sauver nos vies ou si nous devions rester à notre place. Comme celui qui s'endort au sein de la mer, [tels] nous fûmes en nous couchant et comme le naufragé dans la furie des vagues, [ tels] en nous réveillant. Notre âme fut en désarroi et l'esprit faillit nous quitter. Jusqu'au 21e jour du mois, nous ne sûmes à quoi nous en tenir sur les intentions de la flotte. En plein jour, nous levâmes les yeux et vîmes qu'elle prenait ses dispositions pour nous combattre. Notre cœur faiblit et nous perdîmes la tète: nous nous voyions comme des brebis prêtes au sacrifice. Et nous nous disions: « Notre espoir est perdu, nous sommes condamnés. » A peine achevions-nous de dire ces mots que nous entendîmes le fracas d'une grande secousse, un tremblement, des détonations et le bruit terrible [que faisaient] de grandes pierres [projetées par] des creusets de fer et appelees bombas. Tout cela se passait derrière nos murs et, pareilles à l'effervescence d'une chaudière, des fusées, des flèches et la mort montaient sur nos fenêtres. Et nous tous ensemble, nos femmes et nos enfants, nous nous considérâmes comme des bêtes. Parmi nous, il y avait des gens qui voulaient fuir pour se sauver; mais ceux qui parvenaient à échapper d'un piège tombaient dans un autre plus dangereux encore, entre les mains des Arabes qui habitent notre ville. D'autres couraient d'une cour à l'autre, d'un coin à un autre coin, criant, pleurant et se lamentant. Les hauts cris des enfants et des nourrissons s'élevèrent devant le Seigneur notre Dieu. O.notre Dieu, qui va s'apitoyer sur notre honte? Devrons-nous périr d'une mort sans gloire, nous et notre pays? Et nous fûmes impuissants comme le sont les sauterelles devant les cris de la foule. En une minute, nous subîmes quarante coups, et si cela avait duré vingt-quatre heures, nous aurions pu être assimilés à Sodome et Gomorrhe, qui furent détruites en un instant, juste le temps de se courber pour faire une révérence. Et tout le peuple écouta le tonnerre et vit les éclairs [des détonations], et le feu se répandit sur la terre de notre patrie. Dans notre camp, tous soupiraient et se lamentaient devant tant de tribulations, car ils croyaient à une mort certaine.

 » Après midi, la miséricorde et la pitié divines augmentèrent et notre prière fut exaucée par Dieu. Il se leva du Trône de la rigueur pour s'asseoir sur le Trône de la miséricorde et s'apitoyer sur nos restes. Les pluies de la fureur tarirent et les grosses pierres cessèrent de tomber; le tonnerre cessa de gronder complètement, comme si rien n'était arrive.

Louanges à Dieu, notre Rédempteur qui accroît Sa bonté pour nous, le seul qui opère de grands miracles. Nous n'avons pas assez de mots pour remercier le Seigneur de nous avoir protégés contre les bombes qui passaient au-dessus de nos têtes et qui tombaient même devant nous. Grâce à Dieu, béni soit-Il, personne ne fut atteint, le filet se déchira et nous fûmes sauvés. Et Dieu disposa favorablement les Arabes qui nous entouraient, et ils ne nous causèrent pas le moindre mal. Hommes de notre génération, considérez comme fut opéré le miracle avec toutes ses conséquences. Béni soit notre Dieu .

 »Et parce que Dieu fit cette journée, égayons-nous et réjouissons-nous en elle  avec la joie qui est due à un mois dans lequel la tristesse fut changée en allégresse. Nous devons donc louer, glorifier et exalter Celui qui fit pour nous tous ces miracles, car « l'Eternel a fait de grandes choses pour nous  ». Et nous nous souviendrons de cette journée tous les ans pour la célébrer comme jour de festin et de joie, pour nous et nos descendants, afin que tous fassent des dons en faveur des nécessiteux, chacun d'après ses [moyens, dons destinés à être] distribués aux pauvres. Qu'il est beau le [sort qui est notre] partage !Nous appartenons à notre Dieu et c'est vers Lui que nos yeux se dirigent. Qu'il fasse un signe heureux à notre adresse afin de rassembler nos dispersés et pour élever notre étendard! Que le Rédempteur vienne à Sion bien vite, en nos jours mêmes! Amen! » La deuxième partie de cette meghillah, qui commence avec le 7e verset du chapitre LXIII du Livre d'Isaïe, comprend une série de louanges et de remerciements à Dieu extraits des Psaumes et d'autres livres de la Bible. A Tanger, toutes les synagogues possèdent un phylactère de parchemin sur lequel sont écrites ces deux meghilla-s. Chacune d'elles est donc lue le jour du piirim qui lui correspond. L'officiant doit faire la lecture en public, pendant la prière du matin. Il n'est pas rare de trouver des copies de ces meghilla-s chez les vieilles familles de la ville.
